The driver received a parking charge at Trowbridge Cinema complex which was issued by UKPC.
There is signage which states that to be entitled to 3 hours free parking you must display a free parking ticket.
The driver failed to notice this as we headed for the restaurant for lunch.
The driver has appealed the charge with UKPC stating this was the first time the driver had used the car park. The driver provided evidence that the driver did not overstay the 3 hour timeframe.
Unfortunately the appeal was not upheld.
What options does the driver have? If the driver appeals via POPLA what chances does the driver realistically have of having the charge of £60 overturned?

I'll try again. I did NOT ask you to IDENTIFY the driver. I asked you if gth driver HAS BEEN identified, and in context this would be "to UKPC".
So, do UKPC know who the driver is? Answer ONLY "yes" or "no"
Either way, NOW you MUST edit ALL your posts. "the driver"... is used, you are "the keeper"of the vehicle. They are 2 distinct and separate legal concepts.

Without the driver's appeal submission I am unable to confirm if the driver has been specifically identified. The registered keeper has not been formally identified by UKPC from the documented information the driver has received.

The registered keeper is easily identified by the application to the DVLA. Who received the documentation the keeper or the driver? Hopefully the keeper, one only, Don't elaborate.

So no "notice to keeper" has been received? A simple "yes" or "no"
IF there is no NtK and you THINK the driver was not identified, then POFA2012 remains in play as a POPLA appeal point. In instances where NO NTK was received, AND the driver was not identified, then they uphgold the appeal 90%+ of the time.
