NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Limit? Alleged speed? What make/model of van?

The Speed limit listed was 60mph
Alleged Speed 73.
Make and Model of Car: Volkswagen Caddy.

"How do we prove that reduced speed is in operation on motorways?" Not sure what you mean but presumably you mean WAS in operation at the time of the alleged offence. Presumably there was a reduced limit in operation and you exceeded it .
Others will advise but you need to complete and return the form as instructed and within the timescale given . Keep a copy of it and get a Free Proof Of Posting from the Post Office

The only camera on this stretch is a HADECS3 which come with additional CCTV cameras which record the speed limit signs being displayed on the gantry at the time of the offence.

The van is not subject to a lower limit so one presumes the question is around whether 60 was displayed or not.

It appears this is a HADECS2 area and not HADECS3 so there's no auxiliary snap of the displayed limit - only a log entry.

Additional issue that 73 is greater than 70 anyway.

As said in the post before yours, there is a recently installed HADECS3 at that location.

Globbule, if you have not already nominated the driver, we would suggest you reply to the police requesting any available photograph to assist in identifying the driver. They may then send you a picture incorporating a view of the displayed limit (not sure if the photo from the new HADECS3 does that or not). Obviously if you have already named the driver this ruse does not work and do not miss the deadline for replying, asking for photos does not stop the time running.

There's no HADECS 2 left round the Surrey section. It's a HADECS3 and has the additional cameras prior to the gantry.

Thank you for your responses. I have been offered driver training, which I have taken up. No points, just the cost of the course.
