NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Any questions?

Slowing down when you see the van, while understandable, rarely achieves anything as the device in the van will be able to measure your speed at at least 999m and takes but 1/3 of a second.

Some devices have a range over 999m, so my original comment was actually correct.

Unless you have a defence then no. That would be that you weren't speeding or the signage or order are 'wrong'. There's potentially some administrative 'loophole' but nowadays almost unheard of.

You may be eligible for a course to avoid the points. What was the speed/limit?

I was clocked at 36 in a 30 zone

You will be offered a speeding course where you can learn how such heinous crimes will end the world. Of course you will be a better driver afterwards when you have learnt how be how to be better fixated on the speedo, drive in slow motion and bunch up traffic more making us all safer.

No courses do not work, nor does anyone other than them taking the money think so.

To add to that to a big extent where the speedo points is no indication whatsoever of safe driving. Not only does over policing speed not work in reducing accidents its actually had a very negative effect on many drivers attitudes who now perform dangerous acts to actually try to prevent others they BELIEVE to be speeding.

One example is the massively grown problem of drivers accelerating on others doing what starts out as a safe pass and no doubt has added to head on stats going up.

The number of speed cameras over the last 15 years has grown massively and grown again since the diversion of funds in recent years. Many cameras were switched off until that point due to lack of interest due to no direct profit.

Despite all these cameras roads havnt got safer.

I'm like you I frequent these forums regularly and almost every day I see another thread from people caught speeding who have already attended courses.I myself admit that I have done 2 courses and over the years commited uncoutless speeding offences.Strangely as speeding is said to kill I wonder why in aprox 3=4 million miles I find myself accident free.

As someone who uses the roads for upto 10 hours a day and not sit preaching,i can tell you that 5 miles an hour over a limit is the least of our problems, but keep up the good work!!
