Have court soon for a dangerous driving charge. I have 8 points just now, what happened i was driving home one night 2 police where ahead of me in a unmarked van which i overtook as it was 1 in morning and road was clear and to overtake i was doing around 60 in a 50 zone the police then continued to follow me and claimed to be going 80mph and unable to catch me which is untrue. Eventually 5minutes later turning into my street where i stay the police put on there sirens and i stopped immediately a was met with a abusive officer when i got out my car who said he was going to take my ******* motor off me. They then charged me with dangerous driving and wrote on the statement i was driving on wrong side of road once they where chasing me, they were going 80 and couldn't catch me, they thought i was under influence on drugs and alcohol then breathalysed me which read 0 and then allowed me to drive off. I have my word and 4 witnesses in my car against 2 police. As well as the dangerous charge they have also charged me with careless driving. My lawyer reccomends trying to get it down to careless only before court but i feel like contesting the whole thing what should i do ?

Ok do you reckon it is too much of risk going against the dangerous charge even though the police didnt have speed gun or video evidence and i have 4 witnesses ?

This sounds like Scotland where cops love sticking the word dangerous to anything.

Sadly, the courts also seem enthusiastic about prosecuting it, and and more likely to agree to dropping to careless rather than find you not guilty of dangerous.

However, I've noticed your on 8 points, and careless driving up here tends to be points heavy- ie I've not heard of people walking away with less than 4, which would push you into a totting min 6 month ban. With that in mind, dangerous driving would be a minimum years ban, so you might want to speak with a specialist road traffic lawyer rather than a local jack of all trades type.

I already knew your age group.Sad but its the way it is.

Long and short of it,is your going to end up taking the careless and be grateful.

When you get your licence back, get a car that doesnt attract attention, and even more important learn how to pass the so called attitude test.

i think we all knew what the answer was before it was posted, that said I got a dangerous driving change from Strathclyde police for having a box on my passenger seat so they can sometimes be over zealous to meet their new targets. I got mine thrown out by the PF

Presumably for careless driving? What was the substance of the charge in the end?

I'm sure there was a tiny bit more to the story. rolleyes.gif

i swear to you on the lives of my future children and everyone i care about in life that i'd travelled a few hundred yards from my office car park. pulled over and given a caution for having a medium sized i.e. not above the window line box on my passenger seat.

0.1 of a mile according to google street view from the start of my journey to where i parked

Let me get this right - you were charged with dangerous driving for having a box on the passenger seat, but it was bartered down to a without due care of which you accepted?
