Hello,

So I wrongly occupied a disabled space in my local Cinema car park in Ellesmere Port, due to a lack of spaces.

Come back and UK CPS had struck. PCN on the windscreen.

So my question is do I wait for them to send me a letter or due to their apparent determination in following through with court, get a head start and appeal now?

I've noticed there is a similar thread, but they are at the point where they have received the letter.

Tickets uploaded for perusal.

Any advice greatly appreciated!

As long as it's your car, wait for the Notice to Keeper. It will be full of errors and non-compliance to POFA.
Then appeal, get it rejected, take it to POPLA.
UKCPS are known to pursue disabled space cases to court, so winning at POPLA would be your aim.

Hi Guys,

So after 30 odd days I finally receive my NtK from UKCPS Ltd.

I've scanned and uploaded it to the following link. (The sites built in uploader didn't seem to work)

Any guidance on what to do next is greatly appreciated.

Only in-accuracy I can spot is they've just used 00:00 for the time.

So there's a good start: your car was not there at the time specified, so no "offence" occurred.

Their letter is utter tripe. It suggests that because no appeal has been sent within 28 days of the NtD, there is now no scope for appeal unless the vehicle is stolen or sold. That is complete nonsense and not in accordance with the BPA Ltd AOS CoP they are so keen to rely on. You must still appeal this in order to get a POPLA code.

I assume there's more on the back of the letter. Need to see that, too. May have info on POPLA.

Nope nothing on the back, just this single sided letter.

So I assume i'll need to Appeal to get my POPLA Code. Is email okay? Or do I need to do it in writing to their address?

Should me informal appeal (which I know will just be denied) just state about the time?

Your best bet IMHO is to Google these words:

'UKCPS address the factual issues'

The results will be lots of forum threads from here and MSE recently where people have been in your shoes, showing how they appealed to UKCPS, and then the next template fob-off letter which includes the above phrase! And usually does NOT include the POPLA code so don't hold your breath...

You need to read those threads to copy what others have done to get the POPLA code out of UKCPS. DO NOT miss your appeal deadline because you will win this at POPLA if you follow our advice about the wording at that stage - and if you don't bother, you need to be aware that UKCPS do take people to small claims over disabled bay abuse.
