Hi there, I got caught doing 100mph on the M40 in a 70mph zone by a van most probably some sort of gun. I will be going court sometime soon still waiting on date and i am aware of the penalty which will either be 6 points or 28 days ban. I just wanted to find out what i can do to in court to get a 28 day ban instead of the 6 points is there any route i can take to make this happen? Thanks

7 to 28 day ban actually. If you want to be banned to avoid having your licence revoked as a new driver or to avoid a 6 months totting ban, you should be aware that the guidelines used by the courts advise them not to do that.
One approach is to say words to the effect "I realise that at this excessive speed a ban is inevitable, but I ask you to keep it as short as you feel able" -------------------- |

If you've currently got a clean licence and held it over 2 years why would you prefer a ban to 6 points? Surely your insurance co would penalise you more for a ban?

Usual advice is to try a few online insurance quotes comparing the premium impact on 6 points or a short ban. (If trying to minimise the premium impact)
-------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

The received wisdom is that points are preferable to a ban if it can be helped. A ban has a bit of a stigma attached compared to points.

YMMV, but when I played around on GoCompare I found that there wasn't much difference. Either 6 points or a ban of up to a month would add about 25% to my premium. Might be different if I was in a higher risk group I suppose - I'm generally quite boring from an insurer's perspective. I can see why people might prefer the idea of a short ban now than being half-way to a 6 month ban for the next 3 years. It depends on how likely they think they are to be caught at 100mph again. |
