Managed another ticket today for parking at a Worcestershire Tescos laugh.gif Just in case they are reading this & put 2 & 2 together I admit to being the driver, but I am not the RK.

I saw the "gentleman" issue the bit of paper & tried to make conversation, but he did not feel so inclined, maybe my laughter upset him.

Usual rubbish, PO box number & automatic credit card acceptance 0845 number. Amusingly, if I fail to pay they will add "judicial" expences incurred, is that the correct terminology for a civil action?

The last one I had from them was not followed up so I don't know if UKPC invested their hard earned £2.50 to trace the RK. I do hope that the RK hears from them this time as the thought of them not spending their £2.50 does upset me somewhat biggrin.gif .

Thank in advance, but no advice to my next actions required biggrin.gif

What does cheese me off with this Tescos is that there are barriers & ticket machines fitted, but they are not used, if Tescos were serious about their parking at this site then I would think it would be so easy to charge say £5 to park, refundable if £30 is spent.

Would not help me of course as I don't shop at Tescos, just use & abuse their car park, but it would stop the likes of me doing it biggrin.gif

Perhaps they will carry out their own "judicial review" of your invoice biggrin.gif

Just had the "Final reminder" from a recent jaunt to Tescos, strange, cannot recall getting an earlier reminder, still what do you expect, lookin forward to the final, final reminder biggrin.gif , charges so far, me £0, UKPC £2:50 plus p&P laugh.gif

The obvious ignorable rubbish, but I did note that their web address where you can easily pay laugh.gif laugh.gif is entitled www.payfine.co.uk, strange as it's not a fine.

I don't see any of the legally required company registration details.

The website is registered to UKPC but the applicant isn't one of the directors and gets his own postcode wrong.

We at least have another address for UKPC that checks out with the post office :

1-2 Denham Parade, Oxford Road, Uxbridge UB9 4DZ

You have quite a way to go with your fun with this one, I think UKPC send at least 6 letters. Here's the MSE thread showing exact examples of the UKPC letter-chain:

http://forums.moneysavingexpert.com/showth....html?t=2214803

Do let us know if anything different happens beyond the known examples shown on that link. The series of threatograms should end up with at least one letter from PCS (who also phone people up sometimes - more fun for you!).

Do report them for any missing info, e.g. the company registration details as mentioned by Gan. Hopefully they'll get a real fine themselves!

It would appear that they have omitted to send me their "1st letter" http://i49.tinypic.com/2e17tdf.jpg. I think I should contact them to explain their error & to insist that their b******t is at least sent in the correct order laugh.gif laugh.gif

I will probably get the solicitors letter before the debt collectors biggrin.gif

Why not send them the "put up or shut up" reply letter. Enclose the "1st letter" that they may like to use as a template to ensure that their files are kept in the normal sequence.

Better still, "to assist the process" include a copy of the "debt recovery" template along with a "debt disputed" reply.

If you really want to wind-up send them a "debt purchased" template along with "it appears that you have been defrauded. The debt you have purchased does not exist and I suggest you contact the company for a refund"

Just had a frightening letter laugh.gif from Debt recovery Plus Ltd (they mean read UKPC), directing me to their website www.drpl.co.uk to see just how many CCJs they have won tongue.gif .

Pepipoo (amongst others) must be hitting profits as they state on their site:-

Contrary to what you may have read on various web forums Debt Recovery Plus Ltd DOES apply for CCJ’s against individuals and companies who resist payment. Please don’t believe everything you read on the forums. See the below list for some of the CCJ’s we have successfully applied for in recent months.

There is of course no reason to believe that any of the quoted success stories are not made up, or were for claims not relating to parking.

I scanned the letter for your amusement:-

I think most of them are undefended, default judgements.

They have a try now and then, and drop out if the victim files a defence.

"Apply for a CCJ"

on what planet ?

there is no way to 'apply for a CCJ'

--------------------
Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.

Note that I am not legally qualified and any and all statements made are "Reserved". Liability for application lies with the reader.

Can the names and what are presumably case numbers be used in a search of judgements?

Those are not references you can search. Those are their own made up numbers.

When searched for, two of the companies listed on DRPL's website only come up on that site.

No gasps of astonishment from this direction.

A Google search on a number also led to UKPC only, another surprise rolleyes.gif see:-http://www.ukpcappeals.co.uk/legal

Quotes from UKPC:-

Do we really take people to court and win?
Amateur lawyers posting on internet forums often advise people to ignore PCNs, claiming that they’re not enforceable by law. This is bad advice.

In fact we take people to court every month and in most cases the judge finds in our favour, on the basis that:

  • the PCN was issued correctly
  • our signage was clear and properly displayed
  • and the charge made was fair.
In this case you would be issued with a county court judgement (CCJ) detailing the amount you need to pay us. Taking into account the original charge plus interest, legal expenses and costs, this usually works out in excess of £300.

A CCJ could have a negative effect on your credit rating. Unless you pay it within one month and then pay an additional fee for the details to be removed from your records, the CCJ will remain on your credit file for six years.

Each month 10-20 people receive CCJs from the civil courts after trying to avoid paying one of our parking charges. Here are a few recent examples:

Common defences and why they don't work

The charge is unfair
When we take them to court, people often claim that they decided not to pay the parking charge as they felt it was unfair. However, we have never had a case where the judge has accepted this argument.

By parking at the site you indicated that you agreed to our terms, including the charges we’re entitled to make if you park in breach of the rules.

I wasn’t driving the car
This is a very common defence but a risky one. In many cases we’ll have photographic evidence to prove that you were the person who parked the car on-site.

If you state in court that you weren’t driving the car but are found to be lying, this could be considered as perjury. This is defined as the deliberate, willful giving of false, misleading, or incomplete testimony under oath, and is a serious criminal offence.

End of quotes.

They really must fear this (& other) sites to be counter arguing all of the main points biggrin.gif

Would legitimate case numbers be searchable?

No. You would need to know which county court it was that gave judgement. Even then the court staff would be reluctant to search for you.

Hahaha. RK of my vehicle received this letter a while ago. To put their mind at rest they did write in stating (i) They did not acknowledge the debt (ii) They were not the driver and would not reveal who was

Response was some garbage letter back, cheekily stating something along the lines of "As the RK, if you do not know who drives your vehicle, then you are suggesting that uninsured drivers are driving it, which is illegal, ergo you must tell us who was driving"

Think they were confusing "I don't know who was driving" with "I know who was driving BUT I'M NOT GOING TO TELL YOU WHO WAS"

Anyway, along with this letter came a very generous offer whereby they were prepared to accept a 50% discount of the previous escalated charge. It was at this point I think that the RK was finally convinced that they were dealing with a bunch of... (you know what I was about to say!)

It's been 6/7 weeks since they sent that letter...

Are professional, practicing lawyers not allowed on the internet now?

LOL. Never seen the defence of 'unfair'. Unenforceable yes.

Safe to continue to ignore then. Along with the other 6 or 7 I have!!

And if UKPC link me with their loo roll, the RK & the driver are two different people of which I find IS a reason not to pay.
