Endorsements date on driving licence? Options

Hi, i've just been given an NIP for speeding 54mph in a 40 mph zone, thing is i've already got 9 points currently active on my licence. The dates that are on my licence are as follows 28/08/06, 14/10/06, & 15/5/08, the day the offence was on is 21/08/2009. The question i wanted answering is are the dates on the licence the day of the offences or the day when the payment was made?

Do you have an old paper licence or a photocard an counterpart?
Were these all fixed penalties?

Are they written under a column heading, or scrawled randomly on the licence?

They are the date of the offences--sorry

Its photocard and and counterpart, they say 1. fixed penalty sp30, 2. fixed penalty sp30, 3. conditional offer sp30.

Does it make any difference?

the first two are printed on, the third written in pen, they are all in the endorsement column.

My counterpart doesn't have an endorsement column - only Convicting court code, Date of conviction, Offence code, Date of offence, Fine, Other and Penalty Points.

If they are all fixed penalties, there will be no date of conviction - only the date of offence is relevant.

Not necessarily, but if you are convicted of the alleged offence, you will have had 12 current points (including the new ones) when the offence was committed, and will be liable to be banned for not less than 6 months (exactly 6 months unless you have been banned for 56 days or longer in the last 3 years, in which case it would be 12 months) unless you can show that a ban would cause exceptional hardship (particularly to others).

When s. 172 was only 3 points, you could have effectively put back the date of the offence by ignoring the s. 172 requirement and getting done for that instead - such an offence been deemed to have been committed 27 days after the notice was deemed to have been served on you, but as it now carries 6 points, you would still 'tot up'.

If you have a good exceptional hardship claim, it might be better to plead guilty when the time comes and throw yourself on the mercy of the court.
If not, you seem to have little to lose by trying to fight it.
