Was the NIP sent by first class post, second class or recorded delivery? - First

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - A58 Halifax Road from Littleborough towards Ripponden is about 4 miles long with short 30mph stretch, then 40, becoming 60 as road climbs towards the moors. No fixed cameras so it must have been a mobile but I didn't see one and have no idea where it might have been. I was following a lorry uphill and didn't think either vehicle was travelling very fast but was alleged to be doing 42 in a 30. Haven't done anything about the NIP yet.

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Assuming it was a scamera van then write to them and ask for copies of photo's to help you identify the driver. Do not elaborate or use the words evidence or proof. It that the whole of the lacarion on the NIP. When you get the photo's, wash the ID and your reg off the photo and post it in your thread so others can advise you is there are any errors. Where was the camera?

god knows, in an old van, a horse box, up sum lane covered in cargo nets

theres half a chance of a vague locus defence, if the road in question is 4 miles long

in the mean time write and ask for pices to help id the driver. nor proof or evidence

then we can see what and maybe where and if its a clean ping

dont neglect to return the 172 request in the 28 days
