Hi All

we need a advise regarding Court claim received from Gladstone.

We are the leaseholder of residential block. There is a marked parking bays and non marked space where other residents parked too.

In the past I have contacted property manager and get it cancelled the parking tickets from UKCPM. 2 months before I received a letter from Gladstone about the letter before action and I thought tickets were cancelled so did not give attention but we received court claim letter dated 08/09/2021.

I have try to contact property manager but it seems she is on annual leave.

what option we have, can we disagree and returned back on court address ?

I am in process to find and attached all the communication we have regarding this.

All feedbacks welcome.

Keep checking mcol

Check MSE forum newbies thread, post two. Has a complete and exhaustive guide to the entire process. EVERY question you have is answered there.

DYL # assuming that's your car in the pics above, yes, it is parked on DYL. If this was a public road you can absolutely be fined for parking there. I cannot explain it more than that, so reread what I put above.

I was just checking the MCOL and see below:

A bar has been put in place on this claim. You cannot respond to the claim at this time.

Yes I did immediately.

I research after that on google and it says that defendant submitted the defence and now court will sent a copy of defence to claimant to decide so they can not bring any other action (default judgement)

Just checked MCOL- Its now changed and showing - your defence received.

Letter received Gladstone and they have sent Direction questionnaire. Awaiting letter from the court.

Do we need to do anything at this stage ?

I have gone through the MSE newbies thread.

Check mcol, as newbies tells you to.
You only do your DQ when mcol states one has been sent. Either fill out paper or do online

Of corse, you should be
- writing your witness statement, as yiu know, for certain, you'll be filing and serving one
- colllating all evidence ce you have that supports your defence, and numbering it as you're told to (exhibit INITIALS/001 - a photo showing...)

To who are you talking about?

Court - obviously email is fine
Ppc or their solicitors - email CAN be fine, in theory you should check. But just send via email, and if they com0ain post. They won't complain, it's easier for them
