Car parking partnership parking without a valid permit

Dear Sir/Madam,

I was hoping for your help. I entered a CPP private parking area, I looked for a pay machine to make payment and there was one to be found anywhere, so I read the signage which said I should ‘make payment as required entering the vehicle registration via the payment machine and/or the terminal system’. I looked for one again and it was nowhere to be found so I left. I then received an ANPR PCN which stated I was illegally parked there without a valid permit and that I was there for 10mins 22 seconds in total. I wrote an appeal stating the above reason along with some other technical information I took from the money saving expert website which covered stuff like how the timing is inaccurate due to remote signal, how the land is now owned by them, the signage was wrong amongst other things. I have lost this initial appeal as I entered it onto the CPP appeals website portal and unfortunately did not save a copy and they didn’t send me a copy back.

I have now attached a link which has their their response to the appeal along with images of the initial ANPR PCN, the signage photos, photos of the car park where there was no payment machine, image of the ANPR camera and would really like your help with this.

The parking wasn't 'illegal', this is a civil matter. In effect they signage creates a contract, by parking otherwise that in accordance with the siagne you incur an extra charge (think of it as 'premium parking') they will say.

So how long was the car on site for?

I presume you have given away driver ID in the appeal (note for future, DO NOT)?

Why would you look for a pay machine when it says "PERMIT HOLDERS ONLY" in big font on the signs? There is nothing about paying at all except in the generic font which clearly doesn't apply here. I think you're being economical with the truth to us and we need to work on facts.

10 minutes is a bit long.

You have an excellent defence in that is clearly forbidding signage, by stating permit holders only, the offer to park only applies to permit holders, so non permit holders are trespassing and no contractually agreeing to pay anything. But POPLA won't quash the notice on that basis.

You may want to take down the list of Year9 names at the college, GDPR and all that, could get you into a lot of hot water.
