Hi Guys,

Newbie here so apologies if i've posted this on the wrong thread.

Towards the beginning of June a council traffic warden issued a pcn to my vehicle for parking on a single yellow line. He then takes his photos etc.. and then proceeds to remove the ticket from my car and affixes it to another vehicle. i have all this on CCTV and only becuase my neighbour told me i got a ticket and i was adamant i didnt so i went ahead and checked the CCTV. As i saw him removing the ticket i just assumed he mistakenly ticketed my car and then removed it. (Council did ease parking restrictions due to coronavirus)

Now as you can imagine my surprise when i have received a NTO for the said unpaid parking ticket and asking for double the usual amount.

im pretty sure this is not normal practice, is there anything i can do?

Sounds rather odd but not unheard of here.

If a PCN wasn't served then the NTO is invalid.

Let's see the NTO and go the council site and see if they have pics and post them. It looks like you have struck lucky with CCTV as the pics will probably show the PCN served but it needs to stay there while the CEO is there.

Put pics on https://imgbb.com or such like as space on forum is limited.

Probably best not to post the CCTV on a public forum.

Ah Newham - what would we do without them. I expect member Neil will have something to say about this later.

But you have them bang to rights, as we usually say of people who get PCNs.

I would suggest blanking the CEO's face in those stills as well - it's not a good idea to have any possibility of ID for a number of reasons.

I would just put the video up on dropbox or google drive or similar. I don't see an issue with the CEO's face, they walk around in public all day long and I'm sure they get photographed a lot. There is no reasonable expectation of privacy in public and as you're not a data controller, you hardly need to worry about GDPR.

The guy who got the PCN in the Southwark leisure centre car park put up a video with the faces of two CEOs and nobody seemed to bat an eyelid.

I would add that if the council is idiotic enough to pursue this, you've got a costs award in the bag.

OP - I would put it on a hosting site, set it to private and PM Neil with the link/password.

Reasons for not showing a CEO are that he is not the issue - if he's done something wrong his employer needs to deal with him and I wouldn't want him facing anything from someone on the street having seen him here. Also, the people who run Pepipoo should be protected from any comeback. There is also a privacy reason.

Additionally it says I have 28 days to respond, considering 15 days have lapsed due to postage and lease company processing it, are we ok in terms of time?

This is something we need to look at because, at the moment, you don't actually have an NtO. Leaaseplan need to transfer
liability to you as 'effective' 'owner'. They can do this easily so why haven't they? Was there an accompanying letter?

I've looked at the link and the CEO's behaviour is just bizarre. He appears to want to 'do' the other car too, by using your PCN as evidence
of service. I wonder if they later got an NtO too?

cloudrx, who is the other person who appears early in the video on the right side of screen?

The second vehicle belongs to my brother, he recieved the PCN attached on his windscreen. He has appealed it but still awaiting response.

The other person in video is one of my neighbours.
