Is anybody able to provide any insight into the specifics of the "warnings" given by the police here?
https://www.dailymail.co.uk/news/article-81...s-lockdown.html Are these purely informal warnings in the common usage of the word (i.e. "do it again and you'll be fined/arrested etc") or are they actual police cautions, or something else? Are they recorded and if so, are they permanently recorded, and would they need to be disclosed and/or form part of a criminal record check? |

I would assume they are written somewhere so if you get caught again you are fined. No nothing to do with a Criminal record, even if you are fined you are not given a criminal record. Even if you are charged and sent to court and found guilty, is it even a recordable offence to break the lockdown rules? Of course you can’t be just ‘fined’, you can be offered, and accept, a fixed PENALTY.

Thanks to both of you.
I'm always just a little sceptical of what actually gets recorded, for how long, who might see it and what conclusions they might draw. This is especially because of the presumably unlimited potential of the "Other relevant information disclosed at the Chief Police Officer(s) discretion" on an enhanced DBS check. I'm not in a situation where a DBS check would be a consideration, but a couple of family members are. I'm assuming from the responses that there is not a formal system of issuing and recording such warnings, and perhaps also no oversight. Of course you can’t be just ‘fined’, you can be offered, and accept, a fixed PENALTY. My understanding would be that they would issue a FPN if they saw fit, and your acceptance would take the form of whether you paid it or challenged it in court (rather than any kind of formal acceptance at the time when it is issued). Is that right? No nothing to do with a Criminal record, even if you are fined you are not given a criminal record. I do believe that a FPN could also be listed under "‘other relevant information" on the enhanced DBS check though, but not sure about these "warnings". Is that right? That would be correct, in fact the penalty is halved if paid within 14 days. Strictly you can't 'challenge it in court', you decline it and leave the Police to decide whether to prosecute via the courts or not, if they do you can choose to plead guilty or then defend it in court. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
