PCN Code 19 whilst loading with yesterdays voucher, Old voucher not really displayed code 19

Hello all,

I have received a PCN in a residents bay on Sunday the 01/09/2019. I have had a rejection to my informal reps and now have the NTO. I would like to make a formal representation on the grounds that the contravention did not occur as I was loading and also that the voucher that has been photographed is not purposely displayed.

I had been working in Gordon Road in Exeter getting the house ready for tenants who's tenancy started that day.

I had finished packing my tools and had moved my car to outside the property.

My car had been parked in a 2 hour shared use parking bay down the road about 15 meters, I had moved my car up to the resident parking in order to load my car with my tools which included expensive power tools and some heavy items.

During loading I came back out to the PCN on my windscreen. I had not left my boot open both because the items were expensive but also the gas props on my boot lid don't hold the boot lid up.

I was not more than 5 minutes away from the vehicle.

In terms of the code 19 I did have more daily resident visitor vouchers for this CPZ which I didn't use as I was only going to be a few minutes loading. However the voucher that I used the day before was placed in a tray on the dashboard. This voucher was not displayed in the way that is advised and it is at a right angle to the screen and out of view in the bottom of the dash tray unless you lean over the car to look or in the case of the evidence hold a camera over the bonnet. you can see this in the CEO's photographs.

I've not had a code 19 PCN before so any advice on this and general advice would be much appreciated.

I will upload the the PCN, NTO and Pictures. Unfortunately I cannot find the informal reply letter as I am having my house renovated so it has been misplaced!

Obviously it would be best if you had their rejection letter but can you summarise what you said in your challenge and what they replied?

Nothing to lose now by making formal reps concerning loading and it would help if you get a statement form the property owner or agent?

What were you displaying in the shared use bay? Did you buy a pay and display ticket?

Hi stamfordman,

Thanks for the reply.

I have the informal reps I made I just can't find the reply but I will upload my reps.

I am the owner of the house in the road.

Regards the shared use bay, it is one that is a free 2 or 4 hour period with no return with in 2 hours I think so no pay and display.

Ok, there isn't a grace period for loading it's an exemption to the contravention and you'll need an assertive formal rep at the next stage.

Do you have an docs to show you let the house out and any bills/docs concerning the work done leading up to loading tools.

Yes I have tenancy agreements and maybe an invoice for electrics from the period.

I shall spend some time drafting a formal rep.
