Good evening all,
Today i received a PCN from Parking Eye for a charge of £100 ( reduced to £60 should i pay it within 14 days) claiming that my vehicle had been parked in a car park they manage for over 24 hours where the time limit is 3 hours. The PCN shows my arrival time as being 29/08/2019 at 21:05 and the departure time the next day at 30-08-2019 21:25. Ive checked the dates and was also able to check my location history since i use android auto / google maps in the car and this shows that my vehicle entered the car park on 29-08-19 at 21:05 and that i then left at 21:25 the same day. I then returned the next day to buy a couple of things that id forgotten on my previous trip. Google maps shows that my vehicle entered the car park at 21:19 on 30-08-2019 and then left at 21:25 It appears that the camera parking eye use hasnt picked up my vehicle leaving the car park before re visiting the location nearly 24 hours later. Ive got location history for the two days in question which show the movements for the two days - it even marks out where i was driving due to the speed travelled at. Obviously im looking to appeal this. Having taken a look into the issue i can see many other cases where people have only had a first and last entry recorded and that the double dipping as its reffered to seems to be a known issue with these systems. What would be the best way to appeal this? |

Thanks for the reply.
Would i be best to keep it short using that wording you linked to and to just refer them to the information from google maps showing my time and location to prove my point? Not really sure about how all this process works. Also, i didnt think about the part where they have accessed my details on the registered keeper database without reasonable cause. I presume thats worth mentioning in the appeal to them. |

It's not an appeal; it's telling them
If they don't immediately correct their unlawful action you're going to correct it for them The message is deliberately short because nothing more is necessary No please; no thank you; no empty threats; no room for excuses |

"Dear Sir Ref XXXXXX/XXXXXX I have received your parking notice The vehicle was not parked at the location for this period. Your defective ANPR system has failed to record two separate visits. You have therefore accessed my details on the DVLA registered keeper database without reasonable cause Cancel the Notice within seven days or I will complain to the DVLA about your action Regards" |

They can't reject your appeal or request proof without calling you a liar
This justifies a much stronger complaint to the DVLA that ParkingEye is refusing to correct its error when brought to its attention If they want proof, they can pay the £30 POPLA fee to see it if they force you to make a second appeal to the independent body |

A strongly worded challenge which clearly demonstrates their case is weak and you are not to be taken for a fool will often have PE cancel before you have to go to the hassle of POPLA. So it may be worth providing them a bit more to make them think. |

Submitted the "appeal" to them so now just got to wait and see if they cancel it.
Ive made sure that ive taken a screenshot of the page where they acknowledge receipt just in case. |

Afternoon all,
Just received another letter from parkingeye. Saw the envelope on the doormat and at first thought it was another "fine". Opened it and found a letter headed " parking charge notice reminder" Looking at the letter, the rest of it appears to be identical to the original letter sent other than this one being dated 12-09-19. Is this it normal for them to send out a reminder despite me having submitted an " appeal" via their website? i have the email confirmation to say they acknowledge receipt of my "appeal" Email i had from parking eye states: "Thank you for contacting ParkingEye, we acknowledge receipt of your appeal. We endeavour to respond to all appeals as soon as possible. Whilst we consider an appeal the parking charge amount will not increase. Please note that a full written response may take up to 28 days. Kind Regards, ParkingEye Appeals Team" Ive checked my entire inbox and junk folder but havent had anything at all from parking eye since submitting the appeal. |
