Notice of Enforcement without receiving PCN

A letter of enforcement arrived today 16.08.19 with a date notice issued 09.08.19 stating I had received a PCN on the 25.07.19. It's the first time I ever hear of the fine and says I must pay by tomorrow 17.08.19.

I don't even know where it was, all I can recall is when I forgot to put the blue badge while parking in a disabled bay in town for an hour.

The fee stages are £75 for compliance fee, £235 for enforcement fee and an amount I owe them of £98. So I'm also confused as to how much I have to pay.

Is your vehicle on lease? If not, are your DVLA documents up to date re your current address?

It seems you've missed the PCN, NTO and Charge Certificate somehow.

My vehicle is not on lease, we did move house in April but still have our mail forwarded and changed our address as soon as we could, so there is no way I would have missed any of the letters. I've checked the V5C form and the address was updated in May.

What is the PCN date - can't be 25.07.19.

Check the V5C reg doc for address and date change.

It says warrant issued dated Jul 25, 2019 in respect of a Penalty Charge Notice. V5C reg docs were changed in May.

What council - is there a PCN number on the bailiff notice? The date of PCN is likely to be some months ago and all the docs will have been sent to the address on the V5C starting at about 1 month after the date of the PCN if it was a windscreen parking PCN - did you get one on your car? You need to put the pieces together.

It's Essex County council, there is a Case ID and an Enforcement agent reference number. There is also a ref/account no. and it referes to a warrant issued on 25th July. I did not find anything on my window and had not received any documentation prior to today.

The dates do not make sense. For a PCN issued on the 25/07/2019 the earliest date they could serve a CC would be the 27/08/2019 then they could not serve an order for recovery until 21 days after that. only then can they register the debt and instruct bailiffs

We need to find out something about the PCN. you have the number go online and check it out

As Neil says this is a bus lane PCN and in Essex it's likely to be one of the enforced lanes or gates in Colchester, Basildon or Chelmsford.

If you PM me the car reg I'll try and find it but if as you say it's not online then you'll need to call them to track this down.

is there anything on the back of the letter.

When did you move in April?

It sounds like you might have a good chance here but, with this arriving today you are in a very awkward position.

The amount due is currently £173 but if the bailiff visits after tomorrow it will rise to £408.

You need the correct PCN number and there's little you can before Monday.
Perhaps the bailiff co. will tell you? Then we can get started in advance.

EDIT: what was the address on the V5C before you moved? Something isn't right if you had set up mail redirection from your last place if the V5C was correct then.

If I can't find the PCN online, did not receive a PCN (I still have mail redirection after moving at the end of April) but have received this notice of enforcement. How can I pay only the fee?

I moved on April 27th, but I'm still receiving mail redirection and did not receive a PCN. The notice was issued 09.08.2019 and only received today on a Friday.

I just spoke to my husband, he says it might be a possibility the V5C wasn't updated when we moved to our previous address, which would explain why I didn't receive it. In that case I admit my mistake and will painfully pay the whole lot. Thank you so much for your time.

There is a safeguard in place in case the PCN goes astray as it has in this case. This is the service of a charge certificate that can be issued 28 days after service of the PCN so this would have been after you moved, next an order for recovery that allows you to make a statutory declaration to the effect that you did not receive the PCN. It is usually a tick box but you are now out of time so must also submit an application to submit the SD out of time.

At this point the council can object and usually do, and as a result the TEC tend to refuse the SD, so your out of time must be done with care. Neil is the man for that, if he doesn't mind me saying so


Stamf I take it you have the PCN number if so has the OP?

don't blame the council in your PE2 the PCN went missing you no not why but for the other two forms you had moved, add some sort of proof. Through an unfortunate coincidence in the timing documents went astray and as such permission to file the SD out of time should be granted
