Four months ago I sold my car and submitted the seller’s part of the V5C to the DVLA advising them of the new owner. Today I returned from holiday to find two PCNs from Westminster Council for moving traffic violations and one from Transport for London for entering the ultra low emission zone, all sent to me as registered keeper. All offences are dated 25th June, which is 2 days before I left for holiday.
I mailed the V5C the DVLA by second class post and don’t have a receipt for this. I have the name of the buyer but not his address. I plan to write to Westminster Council and TfL stating the date I sold the car and including the buyers name and telephone number. Is this a reasonable approach? |

This needs to be in the council section.
Did you receive confirmation from the DVLA - and if not did you contact them as stated to check? -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

No confirmation received from DVLA and I didn’t contact them as I wasn’t aware I should. I heard nothing from them regarding the transfer so assumed all was ok.

Wrong assumption, you are requested to contact them if you do not receive an acknowledgement within 4 weeks of notifying them of a change. It is particularly important that you receive a note from them confirming you no longer have responsibility for the vehicle. Posted DVLA by 2nd Class only and without free Cert of Posting only means you cannot rely on the Interpretation Act.

Any evidence that you were no longer the owner such as advertisements, bank records, cancelling your insurance ?

However the law requires this(source Gov.uk): When you sell your vehicle What you do with your log book depends on where the buyer is taking or registering the vehicle. Staying in the UK Give the green ‘new keeper’ slip from the log book to the buyer. You must tell DVLA you’ve sold the vehicle and give them the full name and address of the buyer. You could not notify DVLA correctly without the buyer's address. Contact DVLA and establish the current situation. At present we and you are guessing e.g. were DVLA in the process of changing RK details when TfL requested the details, do DVLA have your incomplete notification etc. Find out. It is pointless speculating. |
