Hi new here so bare with me if I'm just covering old ground.
PCN from britannia in Scotland. The letter is addressed to me as I'm the keeper. I am not the driver. It says didn't make adequate payment. Photos of driving in and leaving times and number plate. No photos of car parked to show no valid ticket displayed? It does say wording around the lines of if I was the driver I'm liable or should transfer liability. But it seems by reading on here there is no owner liability in Scotland? But they do have my name and address. Just wondering where I stand. Do I appeal on the ground it probably is inadequately signed considering so many others have fallen foul in a short space of time. Or do I ignore if owner liability isn't enforceable and they can't see anything on the photos and there is no photo showing lack of parking voucher? Any advice would be great. Thank you! Edited as per advice to avoid confusion and liability This post has been edited by Kdeedee: Mon, 14 Jan 2019 - 18:57 |

So you should follow the forum rules and create your own thread rather than hijack otheres.!!! So delete the the post you made here and in the new thread don't hint at the driver. Use "the driver....." etc. And post up a redacted copy of the PCN received, both sides, leaving dates.

Any advice would be great. Follow the one case one thread rule please so advice doesn't get mixed up, click the !REPORT button at the bottom left of your post and ask a Mod' to split it off for you. Meanwhile also edit your thread, refer to the driver only as 'the driver' and you as 'the keeper' DO NOT EVER give any hint as to who was driving. If you are in Scotland then you file (keep) but ignore, they have approached you as keeper, you have no liability as keeper, the fact they have your name and address (same as pretty much everyone else who gets a postal ticket?) makes no odds. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

As mentioned I was new here. It was the same company and same country hence why I found the thread and was more looking to see if the advice was still as given above to the original poster and additional subsequent posters. But I've edited the post And will as another post suggests ask admin to separate it. Thank you for your reply.

My apologies as mentioned new and had only come across the site searching the company and Scotland. I guess I was more checking the advice was as give above to the other posters. But will ask it to be split as you pointed out and have edited as well. Thank you for your kind guidance! Any advice would be great. In Scotland you just ignore as there can be no keeper liability in Scotland (owner has nothing to do with it). They got your name and address from the DVLA as the registered keeper.
You could write and tell them that you are the keeper and were not the driver at the time and that there is no legal requirement to tell them who was and you will not be doing so. They are not to contact you again |

Thanks for that ostell, do you think that is likely to encourage anything further from them or hopefully just put it to bed?

It could make them wary of continuing as they now know that you know they can't succeed and further threats will have no effect.
But take out that talk about the car park |
