Failing to furnish driver details

Hi All,

Quick question, in May 2018 I received a speeding NIP from Surrey Police, for doing 48 in a 40 average speed check zone - I filed this in the laterbase and basically never sent it back with my details on.
Shortly after I received a letter from them saying as I hadn't responded to the NIP they are now going to consider charging me with the separate offence of failing to provide driver information.
Obviously, I should have taken the speeding fine on the chin and got the 3 points or even a course so believe me I don't come here asking for sympathy or offering any excuses I am in this situation because I was too lazy to fill a form in and send it back.

What I would like to know is I understand they need to lay charges within 6 months, I am a little confused when the 6 month period started was this from the commission of the actual speeding offence or when they sent me the letter saying they're considering prosecuting me for failing to provide? It is 6 months on the 11th of this month since the speeding offence took place so I am wondering realistically how long should I be awaiting Mr Postie to deliver me a summons?

And secondly, is there a possibility they've just binned it off and not bothered? Seems highly unlikely to me but I just wondered if this has happened before?

For the failure to furnish offence, the date the counts is the last day of the 28 day period. However you would normally be dual-charged with speeding and the section 172 offence, and CPS policy is normally to drop the s172 charge if you agree to plead guilty to speeding. It

Also they only need to start court proceedings within six months, they might take a few more weeks to actually send you the paperwork.

If it’s nearly six minutes moths from the speeding offence they have, as CP points out about another 5-6 weeks to commence proceedings for the failing to furnish, you may not get that paperwork for up to 4 weeks after that that, so about 10 weeks total.

Just as a matter of curiosity if you don’t mind, I’m interested why you decided not to respond,
