Given Ticket after warden instructed me to park with disable disk

I hope someone can help.

The driver went for a market research interview for an hour in a section of Manchester that theyve never been to. Its fairly new.

They drove down the road first and saw double yellows, and some signs from a private parking company on boards round building sites along that road that it was a private road and no unauthorised parking. They turned the car round and looked out to ask someone where they could park. They saw a parking warden across the road and called him over. He said it was fine to park on the double yellows with disabled disks for 3 hrs. Which is what they did.

An hour later when they came out there was a ticket on the car from parking patrol. The driver was so stressed, upset and shaking.

They went over to some of the workmen to see if they saw the driver speaking to the warden, but they didnt, but they did say it sounded like he told them to park there so he could book them.

They then went into one of the venues in the area and they phoned the company and they said the driver should email in and they will sort it. The driver asked if there was cctv where they were and the man in the venue didnt think so.

They came home and phoned the company again, twice the company put the phone down cos they were so upset and panicking.

They rang back a third time and the company asked for a description of the warden and straight away said he wasnt one of theirs and he mustve been council. We tried to get thru to the council but had to leave a message.

There are no official signs on the road at all to state it is private apart from the parking signs which are set quite high up on the side the car was parked on and surrounded by graffiti.

We are drafting a letter to the landowners, but as they own the whole land and not any of the social premises on the land we cant threaten with not frequenting there again, weve explained exactly what happened and if theyre able to access cctv to prove the driver spoke to a warden and turned round and parked up straight after. but what else should we outline to them and what else should we do to appeal?

They went today to earn a little extra cash doing the research as over the last 12 mths theyve had a stream of cowboy builders ruin their home and take a massive amount of money and now on overspend getting the house put right and cant work, they also had brain surgery 18 mths ago of which there is a complication which gets worse when upset and stressed, so this fine and the worry that goes with it is the very last thing needed.

PLEASE HELP, in a hell of a state about this. Thank you in advance

its edited, has it been done right? the calls have already been made to the company in such a panic, so what now? which company? are you referring to? thanks

ps. are you saying the parking companies watch these forums to pick up evidence for themselves? do you want to know which parking company it is, is that what you meant by company?

Yes, or malicious people with the wrong agenda might pass details to a PPC; it's been seen before.

Yes we need to know which parking firm, please. And you need to simply search for other threads about them, and learn what will happen.

STOP PHONING A SCAM FIRM.

Stop thinking that you have to 'prove they spoke to a warden, who cares about that?

The PCN is a scam private one and they make it up, they are as bad if not worse than cowboy builders. Tell us which cowboy?

its difficult to compare other posts as the driver was told by a traffic warden/parking attendant to park where the car was and had disabled disks clearly showing and apparently it is a private road, even though there is no official sign saying so, just the parking signs. most people would trust a traffic wardens word for the correct places to park but without cctv theres no way of knowing if they were a council or parking company employee.

UKPPO? No need to get in a state about them.

Like here, this is quite rare because this person is fighting them in court (UKPPO are not known for it but the person has 4 scam PCNs):

NONE of the above matters, stop fixating on a pointless detail of the scam. It was probably the PPC's own employee setting you up for a fall.

haha its a figure of speech, but ill amend it.

why is there no reason to get in a state about the ticket with this company?

what do we need to do at this stage? do we write to the offices of the landowner there?

It points out:
- how many other UKPPO threads there are so you can understand the company. this of course assumings it IS UKPPO, when youhavent gibven us the full and EXACT name, including any suffixes, of the company in quesiton
- how theyre (badly) handling their only court claim we know of.

What research on appeals have you done? Noting, of course, that the precise circumstances of the charge notice rarely matters...

I havent criticised, im trying to find out where the driver stands. my boss used to work for a parking company and he has said it wouldnt matter if the police had said it was ok to park there, if the parking company are on that ground then we dont have a leg to stand on. i dont understand any of this, the driver parked where they were told it was ok to park. Every parking company is different, my boss said if theyre part of BPA then they will win. Do we write to the landowners agents to ask for their help and do we email the parking company as theyve asked us to do?

So the signs said no unauthorised parking? So there was not an offer of a contact to park. The only claimant would be the landowner for tresspass.

the only signs on the road saying it was a private road are the ones from the parking company, there were no official road signs stating it was private. those signs are attached to boards around building sites on the road. once the driver saw those signs they drove along the road and saw the parking warden and spoke to them, they said it was ok to park on the double yellow lines with the disabled disks.

isnt the company contracted by the landowner to cover their land?

without a parking company on the road, double yellow lines are usually the things that stop drivers parking, except disabled drivers obviously, it wasnt a car park that the driver was on, it was a road that is supposedly a private road.

is emailing the landowners agents the correct people to deal with in this instance then from what you said?

Can you answer the question asked please.

If there is no contract offered for parking then they cannot then claim a breach of the non existent contract. As there is no contract only the landowner make a claim, and then only for trespass

Ostell = what do you mean by contract? the signs say no unauthorised parking, but the driver was told by either a traffic warden or their parking attendant that it was ok to park there. we have now been speaking to the council and theres only one possibility with them as to who the warden might have been. they will get back to me in the next few days but they think it might have been the parking companies employee as their wardens wouldnt normally be walking across the area.

Nosferatu1001 = are you always this rude to someone who obviously needs to get the right help and advice??? you may be experienced with all of this but im not!!!
