Parkingeye Popla refused appeal, Parkingeye issued PCN parking for 11mins

Hi
I wonder if someone could help me for my options
I received parkingeye fine to park at GP backside parking this parking was for staff and patients both , I parked but came out within 11 minutes it was full of wrongly parked cars , I went at front and enter Reg number at GP’s screen as per instructions but they said couldn’t find any details so refused my appeal and asked me to appeal to POPLA which I did they also refused for same background and said to pay £100 within few days I don’t have much time left to pay but I’m sure I’m not wrong
I even asked them to check myself in gps cctv but they didn’t responded

Please let me know what’s my option is there any further I can go I’m worried they if I didn’t paid they might send bailiffs

They can't send in the bailiffs.

Complain to the practise manager and demand that the ticket is cancelled as you were a patient.

Also, how were POPLA or PE going to go get the GPs CCTV? You could have done that yourself - as POPLA says YOU must supply evidence.

The GP may or may not have it now...

Hi I spoke to Gp practice manager who look after these matters , she initially said that sent the request to PARKINGEYE to cancel the ticket , (I was happy) but latter said this ticket is gone to court stage now and can’t be cancelled due to you came to us very late I told her that I wasn’t aware about to ask you to cancel so I been wasting Time appealing parkingeye and Popla etc ,,,
But she said you can still pay them or Court Letter will come !!!! I have no Idea what to Do Now !!! ANY IDEA !?

Get a copy of that initial cancellation request, if PE raise a claim then once a cancellation email is provided in evidence they discontinue the claim. You get stop the claim from even happening by providing it to PE now and telling them any claim will fail as the principle requested cancellation.

How about reading all the other ParkingEye defence threads in readiness? On here and on MSE:

I have contacted again with parkingeye to say it was cancelled by GP but they said we not listening you again as popla has finalised the decision so the next stage is going to court or you still have time to pay £100, I asked practice manager again if parkingeye still offering me to pay £100 , this in not locked situation if you want you can stop them but she responded back to say let parking eye know to do instalments for this fine but it can’t be cancelled , it seems Gp is also getting profit for these fines

It's now a game of nerves. If pushed all the way to a court hearing you have a good chance - but there is a risk of paying £200.

Personally, I'd fight - there's scant justification in the circumstances to penalise patients in this manner.

Following latest response I received from GP admin lookafter this matter,

As I have previously stated the only people who can cancel this charge at this stage is Parking.Eye.
Myself and Admin have both asked them to cancel this penalty charge but they have told us both.that we cannot do so at such a late stage.
I do hope you win your appeal.

Thanks , somehow I went on parkingeye website and entered same PCN number and followed their challenge stage, and in comment section I mentioned that “ you’ve been sent the request by the Priniciple (GP) to cancel this fine but you haven’t yet if you’ll take it to court I ll show the email as prof “
But they came back with this response:

(We recently received confirmation from POPLA that your further appeal had now been considered and that POPLA had found in ParkingEye’s favour. A copy of this decision should also have been provided to you and you were advised to pay the outstanding amount of the Parking Charge in order to avoid further action.

We can confirm that £100.00 remains outstanding and full payment is required to prevent further action.

So there’s nothing yet , I haven’t received anything from them yet, although I also made complaint to NHS Ombudsman about GP practice manager as why they didn’t responded me about my complaint instead of just their admin , DONT know if this will make any pressure to them to officially stop this procedure, thanks

That won't stop PE but you will, we hope, be ready and already know how to acknowledge & defend the claim already. Hopefully you have been following the advice you have had, and have been:

You should have complained to the GP at the time. I can never understand why people do not do that first, why would someone have to tell you that's an option, of course it is, first port of call is the landowner/retailer or clinic, Hotel or hospital where the offending fake PCN was issued.

After many days I just received the PE letter , giving me further 14days to pay and this time they quoted me Supremer court case was won by PE , please check attached letter
If someone can advice further please

This case was entirely different to your case.

It is always quoted by PPC to put pressure on you.

So PE have not sent you a LBC and started legal proceedings yet in which case it is not too late for them to cancel. They are simply choosing not to cancel in the hope that you will pay. Quoting Beavis is the usual BS at this stage in an attempt to get you to cave in and pay. I would write to them again making it absolutely clear that you will not be paying them anything and remind them of the cancellation email. You can add that the email will be presented to the judge as part of your defence should they choose to proceed that far. Note that PE only take 0.1% of PCNs to court and as they lose money on each one they will choose ones with a better chance of winning than this one!
