NIP received for reduced variable speed limit on M62

Just received this 6 days after the alleged offence for doing exactly 70mph on the M62 near Leeds where they say the variable speed limit at the time was 60mph.

Name, address and vehicle are correct, but I really don't remember it being a 60 limit and can't think why it would have been given the distance between me and the car in front.

Right now all your being asked is to name the driver. Failing to do so is a separate offence. 70 in a 60 should result in a SAC.
Limits can be set for all sorts of reasons, not just because of traffic volume.

Do you think I may be jumping the gun too soon? It's just that I read the letter as their intention is to prosecute?
I suppose an SAC wouldn't be the end of the world if it's possible to be offered one for being 10mph over.

Limit wise, there was light traffic, bright dry morning, no road works. Seems difficult to justify a reduced speed limit if there was one.

All that is irrelevant to the offence.

To satisfy your curiosity you could ask Highways England why the speed limit was reduced, but their response is extremely unlikely to help.

Yup, right over that gun, the only recourse if you don’t do the course or accept a fixed penalty is to prosecute, as they have to notify you now that they MAY prosecute that is what they are doing.

It’s HADECS3 so there’s an auxiliary shot of the limit so there can be no argument.

After naming the driver they will offer a course or fixed penalty. You can accept one of those to avoid prosecution or opt for court but you don’t appear to have a defence so that would be a costly option.
