NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - January 2018 Date of the NIP: - 7 days after the offence Date you received the NIP: - 8 days after the offence Location of offence (exact location as it appears on the NIP: important): - A542 Llandegla,Wrexham Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - First If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - NIP claims car was Exceeding the Speed Limit at 57 mph. The car on that day and time was not in that area it was on way back from Holiday and would not have been on the road claimed. Neither of us have ever visited the town or that area. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - No Do you know who was driving? - Yes NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

Just write back explaining where the car was, and that it couldn't have been at the location of the allegation.

May also be asking them to double-check the images/provide them to help identify the vehicle/driver - this could well be a plate misread.

A phone call (bemused or otherwise) to the ticket office should do the trick - try this first, then come back and let us know what they say

[NIP Wizard] Wrong Location on NIP Are you saying that the driver of your car was caught speeding elsewhere at the time specified on the NIP, and they simply got the location wrong? -------------------- Andy
Some people think that I make them feel stupid. To be fair, they deserve most of the credit. |

Not that we are aware of. How do you know till you get a NIP? If that is the case it certainly was not on that road or in that area. As we where on Motorways & dual carriageways its 70mph we went past no road works so as to drop to 50. The thing that confuses me is why its not saying 57 in a 50 zone or is that not done. We came of the dual carriageway some 60 miles away from that location, plus our route which we do often takes you in a straight forward path you would have to make a detour miles out of the way to get to that location.

Get in touch with the ticket office and ask for photographs "to help identify the driver". This should help you discover whether your vehicle was really there or not.

I suggest the bemused phone call - they will likely recheck the plate and realise their error.
...or perhaps it's something else. Many would suggest making this call after 14 days have passed so a corrected NIP cannot be issued. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Been away for a few days got back today and opened post to find a letter from Speed Awareness team lol. Posted two day after their first one saying no further action. Someone else must have rung them and complained they weren't in that place. Must be cancelling all their tickets for that afternoon lol.
Thanks for all your help |
