Date of the offence: - November 2017
Date of the NIP: - 34 days after the offence
Date you received the NIP: - 35 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A30, Meldon Dip Okehampton Devon
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - Not known
If your are not the Registered Keeper, what is your relationship to the vehicle? - Company car driver
How many current points do you have? - 9
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Dual carriageway, clear road. Steep downhill run with overbridge at bottom where a camera van must have been positioned. I was completely unaware as I do not tend to look up at bridges when I am driving. The car provided by my employer at that time was a large Toyota Avensis and was less than a month old. It runs silently and without vibration and the weight of the vehicle winds the speed up when going downhill. I travel this road every day and try to be very careful about speed but occasionally it creeps up without my being aware. It was a mobile speed trap positioned to generate results and I am a sitting duck due to the miles I cover each month and the large car I am expected to drive.

What speed and in what limit ?

Have you done a speed awareness course in the last 3 years ?

You should be offered a SAC for 84 in a 70, but worst case should beca FPN with 3 points & £100

That sounds encouraging .... but would an SAC offer still apply when I'm carrying 9 points already?

In that case, you are probably looking at a custodial sentence. Probably no more than 2 months.

Jlc, thank you. I thought that, as a Totter, I would automatically face prosecution and a possible 6 mth ban. I spoke to one of the national legal companies that claim to argue against a ban in court and they immediately told me I am facing a ban. I do, however, get the impression that these companies are just looking to collect as much money as they can from the beleaguered motorists of this country so I am wary of their "advice" .... hence my joining this forum.

If you get a speed awareness course you will stay on 9 points. The amount of points you have now has no bearing on the police offering you a course as that is calculated from the date of your last course. If that is more than 3 years or you haven’t done one before it is likely you will be offered a course.
You could take some paid legal advice but that would cost you a lot to get the same advice you have already had. You may want to save your money for the occasion after your course when you are next out of control of your “large Avensis”.

Maybe I would be closer to the cigar than punting 2 months in prison

In fairness to them, they're hardly going to park up where they know they're probably not going to catch anyone. On the contrary, given speed enforcement is funded out of public money, it's logical to use scarce enforcement resources as effectively as possible, i.e. where there will be a higher number of detections.
