Had an interesting letter through the post from Northamptonshire Police Safer Roads Team.
They are writing to advise me about the move to a smart motorway and the rules on the speed limits. The reason for this question is that they state that they can now enforce the national speed limit as well as the variable speed limit with the overhead gantry cameras - is this legally correct? |

Any speed limit can enforced and its been common practice to enforce the 70mph limit with blank gantrys for quite some time.
The trigger speed is a true 79mph. |

Why would you think they couldn’t?
It was a rumour that they only enforced when limit was displayed - perhaps they are being sporting before its reported that thousands are caught...? -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

I didn’t realise that they could enforce the national speed limit using the blank gantry - only when the variable speed was in place....... good to know! Hi NewJudge, I did a quick search of the net before posting and found some of the legislation referring to the variable speed limits on the Luton stretch of the M1, to my mind it said they would only enforce the reduced speed limit. Would each part of the road network covered by variable speed cameras have different legislation in place? Hi Jlc, To be honest I don’t know why I thought that, maybe it was simply the rumour mill! We’ve had the M1 variable speed limit in place for some time (I’m local to Luton) and never had an issue there - maybe more luck then? |
