NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - November 2017 Date of the NIP: - 5 days after the offence Date you received the NIP: - 6 days after the offence Location of offence (exact location as it appears on the NIP: important): - A127 ARTERIAL RD, LEIGH ON SEA AT ITS J/W BELLHOUSE LANE Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - On the date of the offence, no one was driving the vehicle, it was locked safely in my garage. It may have been driven at the location of the offence two days later, at exactly the same time, so I suspect the date on the camera/NIP is merely incorrect, but I believe I don't need to share this particular piece of information with the authorities? Also I filled out Section A of the NIP before I realised the date was wrong, so I'm not sure what to do with it at this point. Is there any response on the form appropriate for that circumstance? If not I would write a letter stating that on the date in question the vehicle was not driven at all, it was locked in your garage all day, and cannot have been at the location given, so possibly the number plate has been misread. You have not completed the form as no appropriate option is given on it.
In point of fact it is always open to you to reply by way of a letter instead of completing the form. -------------------- |

What is the alleged offence, is it one that would have been recorded on camera or by a witness only?

If there was a problem with the date on the camera then one would expect many people to report the 'issue'. The camera unit should then respond accordingly.
I would ensure 14 days have passed from the date of the offence and make a 'bemused' phone call. Alternatively, (or in addition) you could request a photograph to assist with the identification of the driver - and see if they send the data block. Do you know what sort of camera it is? If you're sure the date is incorrect, they will probably figure it out eventually, but hopefully not within 14 days...

Thanks for all your replies - for some reason I haven't had any email notifications - still figuring out the forum settings.
Anyhow, no I've no intention of responding before their 14 days are up. My main concern is with the fact I'd already filled in the form saying I was the driver before I noticed the date was wrong (it's definitely wrong, I went through that camera on Sunday 5th, while the NIP states 03/11 - a Friday - at which time I'd have been working). So I'm ok to just send a response in the form of a letter, and not send the form, since it doesn't really give an appropriate option for the situation. Also the camera is a red-light camera, not a gatso with calibration lines - I didn't know (until now) they could get you for speeding. The light was green so I thought I was all good. But I digress.. Will wait it out for now and see if they notice their mistake within the next couple of weeks. If not, I'll write back, without sending the completed form and hope that doesn't cause more trouble. |

Yes, many such cameras are speed on green...
You do not have to use their form (but is usually more convenient and avoids some issues) - but the requirements remain the same. (Which in normal circumstances would require signing/dating etc.) But I'd do the bemused phone call first. Just to cover bases - could anyone else have been driving at that time/location? There are some other possibilities such as plate misread or clone. Just to cover bases - could anyone else have been driving at that time/location? Sorry, still not getting notifications for replies. No, the alleged vehicle is my sports bike, which I only use very infrequently (for the occasional Sunday fair-weather ride). No one else has access to it or permission to ride it, I hold all the keys. I use my other bike daily for work, but on the alleged date (a Friday) I was working from home, so that was also locked away securely. I only use my car occasionally. It has now been 20 days since the alleged offence and 18 days since I last used the alleged vehicle, particularly at the alleged location and no corrected NIP has been received, so I'll be writing and posting my response today. Fingers crossed! |

I appreciate and thank you for your advice, Jlc, but I couldn't bring myself to make the phone call for fear of not knowing what to say - I'm far better at putting things in writing than thinking on my feet.
I have just today received the following letter in response to mine; Dear Mr Valiante, So not only did I have the offence withdrawn, I got an apology for their error!
