NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - June 2017 Date of the NIP: - 5 days after the offence Date you received the NIP: - 5 days after the offence Location of offence (exact location as it appears on the NIP: important): - A338 Wessex way, dean park bournemouth Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 6 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Due to multiple address changes in the last 3 years, I could not keep up with updating the V5, and as such could not react to speed offences/letter sent to old addresse in northern ireland. First speed offence happened on Wessex way near Bournemouth in January, I did not realize this until I got a message from my old landlady claiming an important letter from court -ordering me to pay 800£ / and take notice of penality : 6 points. that is around the 14th of June of this year I immediately called central ticket office, to find out, there were 4 more offences , with nip serverd to old address, 4 of them happened in the same place (Wessex way). I wonder what is the best course of action? going to court seems inevitable, what then ? ask for leniency ? on the basis I was not aware of any of the offence til very end ? ...please help NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Unsure Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

Yes, about 25% of people it seems have won an EH argument.
Rant and vent all you want. Its not helpful. What would be helpfyul for you to do would be to look up others EH argumnets to see what has been presented elsewhere. |

Well, nothing seems to be helpful right ? since we got used to get 500£ for few miles above 30 mph, we can get used to a ban and a fine .
This system is cash machine ...and talking endlessly here does not help. Of course knowing for instance, that helping the system, by pleading guilty online, to hope for a 33% discount and facilitate the cash flow of these thieves would produce results is wrong. Plea online --hassle free for them= 440£ Plea at court- hassle- but some humans there = 185£ same offence, same road, same person. that is the only piece of advise I can give to anyone here. Go for the court, this system is cash machine, and machine apply algorithmes, not feelings nobody would help, unless you are a VIP, or some sort of a billionaire. this extortion system is made for us: milking the people under the guise of caring for their "safety". This web site, is a way to canalise our anger ...made by who by the way ? X millions motorist, put some un-realistic speed limits, and guess what ? wait for the cash, so well, that people have to plea guilty ...they will even pay and ask for Leniency instead of turning and wanting to overthrow this sytem |

BTW, you'll never get a £500 fine for a few mph over 30. It'll be a SAC or CoFP which is £100. Even at court the fine wouldn't be £500. -------------------- |

Thanks for the advise, but I will keep my driving license for now ...and no ban in sight, since the judge did not deem it was deserved, I thank the god, for relying on my instinct and on him,
rather than listening to some here, discouraging me about pleading hardship with my wife pregnancy My advise to people is to get a personal opinion by studying their case carefully, and not necessarily listen to pseudo "expert" on this site. This site is a rabatteur site, maybe done by some agents of the state to canalise people anger and help them think, there are not alone So I will have fun as you say nosferatu1001 ... I lost 1700 £ for 35 total miles above limite on 5 occasions , however I ll keep my DL, and hope this racketing system get smashed by the people, and you get smashed while driving with yours. sincerely |

Strange, I see no one saying you shouldn’t enter an EH plea? Which appears you did and they accepted it...

This site is a rabatteur site, maybe done by some agents of the state to canalise people anger and help them think, there are not alone Yes, of course - I look forward to my knighthood any time now. Pretty disappointed I didn't get it in the New Year's Honours, TBH, since we apparently do such a good job luring people in. So I will have fun as you say nosferatu1001 ... I lost 1700 £ for 35 total miles above limite on 5 occasions , however I ll keep my DL, and hope this racketing system get smashed by the people, and you get smashed while driving with yours. sincerely Well if you keep ignoring speed limits then you won't have your reprieved licence for very long, so as someone now on 12 points I suggest you stop focussing on the injustice of being fined for being caught breaking the law, and start focussing on speed limit signs, even if it does mean having a bit less fun. -------------------- Regards,

And don't forget, whilst you celebrate your success, that until you get down to nine or fewer "active" points (which I think will not be before April 2020) that the next offence you commit which attracts points will see you facing a "totting up" ban again. Then you will not be able to make an Exceptional Hardship" plea using the same reasons.

OP I think for you the system worked?
You said you would be happy with fines if you kept your licence, which you have. Courts do sometimes also seem to be swayed by the fact that the intention of the points system is to give you warnings before losing your licence, which didn't happen in your case. Make sure you tell your insurance about them because as others have said it is crucial you don't get any more points for the foreseeable future. Hopefully a lesson learnt that updating a V5C, which only costs a postage stamp, is worth doing. Certainly expensive but the fines are well publicised and unlikely to come as a shock to anyone with a driving licence. Best of luck to your wife if she has not already given birth. A new baby will make this all look irrelevant. |
