Hi,I've had trouble from these idiots for a while now where I live,I tried to find my old topic but couldn't.
I own a non sign written long wheel base Mercedes sprinter that I use for work,holidays and social use,even shopping.I park it on the t junction where I have been told via email by the agency countrywide that the council owns and manages. UK cpm have errected signs roughly 3m in the air on lampposts all across the estate and t junction as well as at the entrance to the road. Last Sunday I received a ticket over night at 04:01 AM,I want to appeal this ticket the best way I Can,I can only appeal via post so it needs to be handwritten,can anybody help me with how to word my appeal please. Here is the email I received from the landowner/management; We do not own any land, however we are responsible for the running of the estate which does not include the T shaped part of the road, which is Council adopted. There is no parking enforcement on this part of the estate as it does not form part of the development. The signs erected are a warning to people wishing to park within the maintained estate. The agreement that you have with your letting agent does not transcend the law. You are actually placing the owner of the property in breach of their terms and conditions, however it is their responsibility to ensure that the letting agents form your tenancy agreement based on their Deeds, which they haven’t so therefore it would appear that your tenancy agreement is voided in parts, again I would contact them about this, there could be other parts of your tenancy agreement that are also void so it is in your interest as a tenant to review this, for your rights. Your comment regarding being ticketed in the homeowner’s parking space is also incorrect. We would not take the homeowner to court regarding a parking ticket, however we would have grounds to take them to court if they continue to allow a tenant to park commercial vehicles on the development. Got a response from scott mculloch and he said the parking control ceased operation 5 months ago and hasnt been reinstated.. where do i stand with the parking ticket i recieved 2 days ago for parking in the car park that used to be controlled by these rules,as a sign is still up in there.
Id been parking my van in a visitors bay for the last couple of months since my van was broken into as i can back it up to the fence and they cant gain access to the back that way. Obviously somebody has sent the pco there or requested him. |

Suggest you send an email to the DVLA and ask them the question that if the authority has been withdrawn how is this company entitled to issue tickets. Ask that it be investigated IF they have got your details from them. |

I stupidly paid the ticket because i thought i was in the wrong,but i had no choice but to park there. It had a pco number on it so if its a self ticketer how would it have that on it?

The self ticketer is given a book of tickets by the PPC and is on commision.
So who did you pay money to? |

Because the land i was parked on is owned and managed by countrywide and i wasnt aware the parking control had ceased operation so wanted to get it off my mind because as ive said before, its causing me a hell of a lot of stress.
I have received a notice to keeper today for a ticket issued on the 21st of jan,but there was no ticket on my screen, so i do beleive its a self ticketer as it was at 23:43pm. If parking control has ceased then are the tickets valid. Youre suggesting i dont pay something i thought i was in the wrong for,and then when it goes to court i have to pay far higher charges? Why should i not have paid it if i thought i was in the wrong ? Im not being rude i just geniunely dont know what my options were. |

Why waste your time coming on here asking for advice and getting yourself all stressed up when you can just pay up and save everyone here the time and trouble of going to great lengths to help you? Just pay them Ben. Just pay them. So write to the parking company and tell them you want your money back as they have committed a fraud. Also report the fraud to the police.

There's no need to be facetious towards Ben. I doubt he'll be back now, but just in case...
Ben, you may have been 'in the wrong' in your mind, but there is no legal basis for charging you £60/£100 for being 'in the wrong' Its an arbitrary made up amount by a company that didn't have the authority to operate there in the first place, and who have now seemingly committed a fraud against you. They won't pay you back though, they're just interested in the money, not in providing parking management services. Now you've paid, expect a whole load more tickets from them, they'll have you marked as a soft touch I'm afraid. Have you seen Henry Hippo's case today? He just got £500 using a counter-claim. |
