Speeding ticket in brighton 1am in heavy fog

Ok so I have been snapped by a camera coming home from brighton, The road itself was a 30 zone I presumed it was maybe 40 not totally sure though and so I go 36/7 mph at 1am, Fog was very heavy but thought doing just under 40 with the conditions as they were, Out of nowhere a speed camera pops up and I did not even see the camera all I saw was the flash flash flash.

Any advice here? Are speeding tickets hard to fight?, I have been back to try and find the same camera and road I used again but failed :/, I def did not believe or know I was speeding until the flash's, Has anybody ever been caught by a speedcam in heavy fog and escaped the ticket being issued?, How do the cameras work in the sense of is it human observation with checking the offence and issuing the ticket, Or is it all automated?

There are humans checking the film evidence of the activations and worse case scenario, the officer in the case may decide a course or fixed Penalty would not be an appropriate disposal bearing in mind the poor visibility conditions, and may refer the case direct to prosecution.
You may be lucky and just go through the usual process of course or fixed penalty depending on whether or not you've attended in the last 3 year, as the speed itself would be in SAC territory.
In that instance my advice is not to do anything to draw attention to your case or 'fight' it unless there is anything wrong with signage or the TRO, but you would need to give the guys on here more details by completing the NIP Wizard when / if you receive a NIP.

Thanks for speedy response square!!!, What about the heavy dense fog does it have an effect on the cameras?, And I am confused as to what the consequences are? could you explain what process is likely to happen?

Thinking about buying a sat nav have been told that they warn you when speed cameras are coming up?

The problem you have is that you seem to state you were speeding. That limits the 'fight'.

What's the location of the camera? If you are the registered keeper then you will need to receive the NIP within 14 days.

A SatNav with a camera database is a good idea but there's no 100% guarantee they will have every camera or that the speed limit on the database is correct. Also, mobile units could be anywhere.

Hi thanks jlc, I only knew I was speeding once the flashes went of though, But yes 36 in a 30 zone is speeding, This happened on the 17th friday gone, I am awaiting something through the post, But am wondering how the dense fog would impact the clarity of the pictures taken? Is it possible that nothing will come through the post? Or is that wishfull thinking?

I went back to search the roads, It was very close to brighton marina, The only road I could find that was as close to the road and location as memory and vision that night would allow, But the speed was 40 down that road, It was also very foggy again last night so visibilty was not the best, I believe the camera to be a gatso from the list of speed cams I have seen.

Googling and searching, This camera describes the exact scenary, Down a steep hill, Homes on the right and grassland on the left as your going down hill, I may drive over there again tonight and snap a few pics if I find it is the right location, Can test out a new app I have to detect speed cameras to lol

If it is a gatso then:-

- it needs to be physically filmed with film. They will still activate if not.
- the pictures need to be clear enough to identify the vehicle and its location on the white markings to produce the secondary evidence.

However it seems to me that if your visibility was good enough the cameras was too.

Based on the description, this would appear the likely candidate. Still an obvious 30MPH limit however.

Edit: OK, probably not this one either, houses on the wrong side.

Nope def not that one, I was coming down a rather steep hill, Grasslands on left, Housing on the right, Vision was very bad it would change as I went down a hill or up a hill, The marina itself had no fog whatsoever, I am feeling like it must be the coldean lane camera..

I am driving down this hill and the fog has got so bad that I could only see the flash going of, I saw no speed signs or camera, Could only make out there was white lines on the road when being flashed and being on top of said lines.

I cant say nothing to that as I am 6/7 mph over a 30 limit, But I would hardly call that speeding, Allthough by the law it is :/, Would of def have hoped that the time of day and the amount over the limit would allow me to at worst pay a fine, But 3 points on license to is just harsh, We live and learn I am firm believer in that but where is the second chances nowadays? :/

Second chance is the awareness course. (Around £100 no points)

Enforcement starts at 35mph.

Ah ok that is def not it either, The hill was huge and it was not overgrown and more open grassland on the left going down the hill, Was a very long hill to lol if that helps.

Nope not that one, I cant stress enough how the whole way down the hill appeareed to be grasslands or very low busheson the left, All the way down on the right was housing, If you check wilson avenue that I drove down several times last night, I swear that is the exact road but can not be as it is a 40 zone lol, But there must be another road similiar very similiar that is a 30 zone lol.

Sorry when I say leaving the marina, I mean leaving it in the general direction towards woodingdean heading back towards the a27 to get back to worthing, I am not overly familiar with brightons roads and honestly feel like I am going mad as I could not locate the camera going back to search.
