Hi,
I received a parking ticket in a resident permit area a few days after moving into my new house. This was received in the period between payment and a paper copy being received. I appealed as advised in other conversations emphasising my permit was paid for and I wasn't advised I need to wait for the paper ticket. Is there any response to this unfair ticket, especially the T&C's bit that I could not view until receipt of the ticket or do I just need to pay? There response is below:

I note from our records that your vehicle was issued with the above notice as it was parked in a permit bay/zone without displaying a valid permit. The issuing Civil Enforcement Officer noted that there was a sign approximately 1 metre from your vehicle indicating that the bay in which you were parked was for Zone F permit holders from 10pm – 8am. I should remind you that it remains the responsibility of the motorist to check the signs in the area which in this case clearly state that the bay in question is for ‘permit holders only’. I can confirm that the Civil Enforcement Officer’s notes indicate that a discretionary observation period was given to allow the driver of the vehicle to visit a property and obtain a visitors permit but as no activity was observed during this time, a PCN was correctly issued. Whilst it is acknowledged that you made payment for your residents permit on 12/09/2017 I should remind you that the terms and conditions for residents permits clearly advise that ‘Permits must be displayed in the vehicle ensuring all the written details on the permit are clearly visible through the windscreen at all times. Failure to comply may result in a Penalty Charge Notice being issued. Paid for permits do not become valid until displayed in the vehicle’. As we have to remain fair and consistent when considering all cases, regrettably, the mitigation you have provided on this occasion is not sufficient to justify cancellation of the above notice.

Don't be fobbed-off ! This is their normal Fob-Off letter and is designed to get you to cough-up at the discounted rate.And it works too, as almost all people cough-up just to avoid the possibility of paying the full penalty. I suggest you wait for the Notice to Owner and appeal again. If necessary, take them to adjudication. I expect they will fold at this point. In the event of you getting an adjudicator who has breakfasted on lemons, there is plenty of time to save up the additional dosh. Only the PCN penalty is in play at all times, it cannot increase if you follow the process to its conclusion.

Agree with Mr I but let's have the whole story.

Date of application for permit
Start date of permit
PCN date
Date permit delivered

Plus - did you see advice on how to cover the period between the start date and delivery of permit? Did council tell you anything? Could you have got same day service from council offices? Do they have a temporary permit? Or issue visitor vouchers? Did you consider this?

Start date of permit was following Monday
PCN received on Saturday in between
Permit delivered on Friday after payment and displayed

Council said would set start date for following week to allow delivery. No advice how to deal with intervening period.

Did it occur to you that you could get a ticket before the permit start date, or before the delivery? I think you have to bear some responsibility for this. You would be on much stronger ground if you'd specified the start date as soon as you were parking and asked about temporary cover.

However, council also at fault if they didn't even ask about whether you would be parking there before the start date.

Let's see the PCN and which council this is.

Hello,

I moved to Northampton within the resident permit area in August 2017. I was eventually able to purchase a resident permit 12/9/17 after gaining a proof of residency document, a long winded process to say the least! I called Northampton to pay for the permit but didn't receive the paper copy till 15/9/17. In the intervening period I parked in the permit area believing my permit was valid from payment, not once a paper copy was received. I received a penalty 13/9/17 and asked for advice on the forum about how to appeal. I followed people's advice and tried to plead innocence and state I wasn't advised on the phone that my permit was only valid when a paper copy is displayed. This was rejected.

I have now received my final and been advised my last appeal channel is the traffic penalty tribunal. What will be people's suggestion for achieving appeal success with the traffic penalty tribunal?

We need to see what you wrote in challenging the Notice to Owner, The Notice of Rejection and the Notice to Owner.
Copy of the PCN for any errors would not do any harm either

This is a copy of the final reminder I have received. I will retrieve the original PCN and take a phot of this when I return home tonight. Unfortunately, northampton borough council being the archaic institution it is, required hand written appeals to the PCN, of which I stupidly didn't make a copy, but I highlighted the fact I was a) a new resident in the area, b) had actually paid for my ticket and c) was not advised when purchasing my permit that it was not valid until displayed.
