I live in the flat which is set within a private property. Some time ago (I think it was in 2013) the property manager has informed that the parking at the property will be controlled by UKPC.
I have received 1 permit + 1 visitor permit however not always I had it visible in my car. I appealed before and stated that this is very frustrating and upsetting as I live at the property, therefore, I am entitled to park there and I believe they should aim for these vehicles which do not belong to any of the people who live there. I was very stressed thinking how on earth you pay your rent, park your car at the property and then you get a ticket of £100? Not £30, £35 but £100?!!Insane! One of the ticket I paid as I couldn't get a response from POPLA so I paid however after I paid POPLA sent a letter saying the parking notice should be cancelled. I contacted UKPC asking for £100 back and sending them POPLA decision. They have never replied despite the fact I have tried several times. Last year I lost the permit somewhere (possibly when left my car at carwash they accidentally bin it). I have sent a letter to UKPC asking to issue a new one but again no response. Since then I got about 7 or more parking notices. I Have never tried to appeal it as I thought if they ignored my previous letters then what else I can do. Additionally, I asked my landlord to contact them about the permit and yet no response from them. And now I am being sent a letter from SCS LAW about the debt owed to UK Parking Control Ltd....The total outstanding is £1,120!!!Maybe it is my fault I have not appealed from these tickets before. I was very upset about being ignored and more importantly getting a ticket for parking at the property I live at. Well...What matters more now is I have no idea what to do. Obviously, I do not want to pay this amount at all. Can anyone help?Is there anything I can do? Thank you. |

Indeed, I would send it in, adding a short additional numbered para (so if your WS finsihed at 20, this new para is 21) that details the above AND references the Head Lease. Again, sign, date, statement of truth. Make it clear this is an addendum.
Add a covering note to the corut, asking their permission to file this amended witness statement, and you trust they will grant it due to the importance. You were delayed in receiving this document, and you sent it the day after you recieved it, one day after you sent the WS (or whatever the timing is). As above, take copies for the day, highlighting the relevant sections - with an actual highlighter - to make it crystal clear ANd you SHOULD hammer them> Its the only way these companies will stop harassing others. So PLEASE put htat costs schedule together. Could be wotrth £500. |

Generally £95 for loss of earnings 1/2 day, £19 per hour you have spent on this case, mileage costs about 45p a mile I believe, costs of printing - postage.

Normal costs are the half a days loss of pay or leave ,capped at £95 and mileage , parking
Then a separate section Unreasonable costs pursuant to CPR27.14(2)(g) Research defence x hours Prepare defence z hours prepare WS Write WS Break it down and give good estimates in whole hours. The more breakdown the more reasonable it looks. You need a short précis of how they've been unreasonable. |

So I was in the court and the Judge said I have to pay what I owe to UKPC.
He said there is nothing in the lease about parking space belonging to the flat and the contract between UKPC and managing company does not need to say is extending after 12 months, it does on rolling basis. No permit displayed- my fault I have to pay! |

I am really sorry to learn the result.
The space does not belong to the flat. The lease does, however, grant the leaseholder and other occupiers of the flat some rights to park. The lease grants no rights at all to the parking company. Frankly, I believe the Judge has got it wrong. You could, of course, appeal. I have to be honest and say that I believe you did not put in enough effort when defending this case. Your failure to get hold of the lease much more quickly is probably what handicapped you most of all. |

Alas, the signs were up and nothing compelling to oppose, it seems - that's the view some Judges take.

I'd suggest selling up and moving on, if you can't get the managing company to kick out ukpc. |
