Unfortunately, I returned home to my secondary address and found a County Court Claim Form issued by Gladstones for a total amount of £418.
This is relation to an issue which took place in September 2016 for car under my name that didn’t have a valid parking permit in place. The issue here is that I was not the driver of the vehicle at the time, it was my brother who does not live at this address to which this form was sent to. I had written a letter to Gladstones about 2 weeks ago when I received their demand for payment and explained that I was not the driver in question. I don’t have the letter to hand, but I can’t remember if I mentioned an address they could write to him at. But I made it clear that the person they were looking for, i.e. the driver, could not be reached here. A few weeks on, this arrives. I’m not completely novice at the whole parking game, but this is the first time I have received a Court related document. In the past I have challenged numerous tickets to POPLA and subsequently the issuers have cancelled the tickets which was an easy defeat. I would rather not proceed with this through court due to the time I will have to invest in research and preparing my defence, but it appears I have no choice. Do I have a chance to ask them to re-issue this in my brothers name? I have a defence from a previous POPLA case I think might be suitable. I will make some edits to it but my defence will be as follows: 1. KEEPER LIABILITY/ CONTRACT BETWEEN ALLEGED DRIVER 2. CONTRACT BETWEEN SIP PARKING AND LANDOWNER 3. AUTHORITY OF ISSUING PARKING CHARGE NOTICES 4. GENUINE PRE-ESTIMATE OF LOSS AND UNFAIR TERMS 5. DRIVER NOTIFICATION AND SIGNAGE One of my issues is that I do not know anything about the signage in the area. I wasn’t driving and the alleged offence occurred in a different city to where I live. I have had a look at Google Maps and it seems that this occurred in a Car Park. Also, there are some options on there reverse of the form, I suspect I need to make a counterclaim to represent myself with my defence? |

If you don’t come to an arrangement to pay within the payment deadline
1) your credit is screwed for 6 years whether you pay it off or not 2) if you don’t come to an agreement they’re happy with, and the value is over £600, they can pay I believe £70 to get a high court writ. With that your car can be taken and sold. Your choice. |
