My apologies, you are of course correct, but to what does the first obstruction comment on the SJPN letter refer?
I know around here, the police are regularly "ticketing" cars in the Peak District, for obstruction when parked adjacent to double white lines etc, which they make a point of describing on their publicity as incurring 3 points as well as a fine, but I though the wording on those was different.

Round our way, when the police attend for various parking obstructions, they also leave a windscreen ticket in a bag if the driver isn't around, which is what I was referring to, albeit with clumsy wording on my part.

Council employees do come out into the Peak Park and leave their decriminalised tickets on vehicle's windscreens for yellow line offences, but the police also attend for those who park outside marked bays adjacent to double white lines, amongst other offences; they too leave bags on windscreens.

p.s. I did tell the guy very clearly not to take legal advice from me, and leave that aspect to the more regular posters. blush.gif

That would be a Fixed Penalty Notice - not a PCN - though.

Hi all, sorry I was not forthcoming as Reading the intro to this forum stated not to give to many details as they don't know who could be reading my posts.
My sister has wrote back to the police and I belive she told them she didn't recieve correspondence, that's all I know! I could not get all the information I or you required so apologise for the bread crumbs.
Her head is not in the right place to take all this in but I thank you all for your input!

She is, currently, cruising towards a very poor outcome.

I appreciate it is difficult to find out what she may have received and what she has done but unless you can the outcome will be much worse than otherwise.

Well hopefully you can get through to her that this is NOT the end of the world and that as I said a simple guilty plea and quoting the guidance will not see any issues beyond the normal punishment for a minor motoring offence.

Her simply writing to the police saying she had not received anything earlier might not be the best way to approach this, but without more info nobody can say for sure.

At the moment she's quite possibly headed towards six points, a large fine and significantly increased insurance premiums. It will almost certainly be in her best interests if you can persuade her to give you the details and dates asked for earlier so you can pass them on here. (In particular, what's the deadline for responding Guilty or Not Guilty to the SJPN she's received?)

It might be possible for the more knowledgeable posters here to advise her as to how to reduce six points to three, and to reduce the fine.

Of course if she can't or won't let you help her there's not much more you can do.

Agreed a motoring conviction isn't the end of the world, but isn't a failure to identify a relatively serious motoring offence? I know I'd prefer to avoid it.

And I'm not certain anybody has suggested a simple guilty plea to either charge yet, as nobody knows any details... ?

It's a bit daft to write to the police to say you've not received anything. Surely if you hadn't received anything how would you know if you hadn't received anything? She must have received something!

She has received something - a SJPN.

I think the OP was trying to say that his sister had written to the police saying that the SJPN was the first she knew of it because she'd received nothing before that.

She's been dual-charged so she need to do a plea deal with the prosecution to get the failure to furnish dropped. It's routine and if you have a look on the forum, there's plenty of examples. She needs to sort out her head issue though because if she ends up with 6 point, by then it'll be too late to go back in time, the time to act is now.

If she can plea bargain as above she should only end up with a modest fine. Convicted of the FtF her insurance costs will be significantly escalated for the next 5 years.

There is also an issue on address.

You stated correspondence went to an old address. When did she move compared to the offsence date and when was the V5c address updated with her current address (if it has been).

Which address was the SJPN sent to ? The old address or the current one.
