Hi

First time on the forum so please bear with me.

One of our drivers dropped off a passenger at Birmingham Airport and within a week the registered keeper received a PCN from APCOA for "Dropping off or picking up outside designated areas". The driver pulled up and the passenger alighted and the driver drove off as simple as that.

Any assistance in dealing with this will be greatly appreciated.

Easy one, as long as the driver is not implied.

The Registered keeper uses the sort of appeal shown on MSE:

Then the registered keeper wins at POPLA using a longer appeal, found on either forum. Search 'APCOA POPLA' on here and on MSE.

Simple to win.

POPLA has decided on many occasions that APCOA's signs are inadequate

There's also the issue that the area is covered by the Road Traffic Enactments and the Airport Byelaws
APCOA can't therefore recover payment from the registered keeper if they don't know the driver

The BHX signage is laughable, it absolutely creates no liability to APCOA at all, plus, as above there can be absolutely no keeper liability so make sure the driver is never identified, not that it makes a lot of difference in this case due to their woeful signage.
