Just got a PCN for driving between a couple of bollards with signage with restrictions, between junctions with Anglesea Rd & Surbiton Rd (F6)

As usual, for best advice please post up a copy of the PCN (both sides)
Do not attach docs/photos, but use this method: Photo or scan. see http://forums.pepipoo.com/index.php?showtopic=36858&st=0 for how to do it. I use Tinypic for stage 2 with no problems. STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image - beginning with IMG and ending /IMG (include all the square brackets [ ] ), and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post. Using the attachment method is not advised as it means quickly running out of attachment space. Redact/obscure personal details, PCN no. Reg No. Also post up a GSV (Google Street View) link to the location. LEAVE IN all dates/times; precise location, Contravention code and description. |

This irksome Council has got this honey pot working perfectly --there is little an appellant can do and the majority of cases fail at Tribunal. Access means the properties between those signs and the no entry prohibition at the far end. Most visitors to the High School are exempt if the camera shows them entering the grounds. If you go past the prohibition signs and drive straight on--no chance. Mick |

This made the council half a mill or 800k in 5 months! But yeah signs are visible!

My understanding is that if a motorist approaches along Anglesea then there are no warning signs and this has been used successfully at appeals. Has this situation changed? |

A Stanton-Dunne decision last month:-
217015521A (extract) I allow the appeal in respect of PCN KT58778342 because I agree with Ms Mallett that the signage of the prohibition in Surbiton Crescent is not adequate to alert motorists to the restricted access. The prohibited entry for motor vehicles lies immediately beyond the left turn from Anglesea Road. There is a no entry sign attached to a pole on each side of the road. The sign on the right appears tilted at an angle which does not directly face the approaching motorist. More importantly, however, the motorist's attention is primarily drawn to another sign which is much more at eye level and placed on the road to the right of the no entry sign on the left hand side. This is a give way to oncoming vehicles sign. None of the signage directly faces the driver making a left turn from Anglesea Road. In my judgement, this is too much signage for a motorist to attempt to take in. The signage at the prohibited entry point is a recipe for confusion. A motorist seeing the give way sign will be thinking that they must give way. There is only so much information that a motorist can reasonably be expected to process when in transit and this is simply too much in one place, none of which directly faces the driver making the left turn. ---------------------------- Still would not risk the discount since no other adjudicator is obliged to follow this decision.
