Hi Guys,
Another of my work colleague got the letter today through the post today and now he has to get in touch with the courts (county Court Business centre). This is to do with the parking on Deepdale retail park, where the car Tyre was touching the white line, between the 2 white lines. Driver was complaining this is jsut stupid to get a PCN, instead of warning letter not to park on the white line. He ignored it as it is was Private parking charge notice and now he has got the court letter. it happen back in 2017 and it was someone else who was driving the car and now this has come to the registered Keeper. I told him you should of Put the liability to the driver and the Driver move to another city in uk. Do you guys have any advice on this or does he contact the court or ignore . It does unless they were to try to resurrect it with excuses etc, never say never, but that is what is meant in the court order you showed us, because claimants and defendants are ordered to comply or risk the consequences and that includes trouble reinstating the claim
There would be no nothing to stop them issuing a new claim with proper detailed particulars etc |

They are not permittted to raise a new claim if this gets struck out - which would be the usual response by a court if the claimant misses this court order deadline, as they're then in breach - as that would be an abuse of process.

Note - they can start a new claim. It won't be magically barred. But no,solicitor should touch this with a barge pole as they are officers of the courts FIRST and they will know for sure this is an abuse.

My colleague told me last night he received a letter from courts and it had been struck off and they did not reply (claimant) by deadline 28th December 2022 and the Defendant had to reply by 12th January 2023.
I will ask him if he has the letter , so I can upload it here. Defendant did not submit his evidence or his side story. So he was happy with the outcome.
