Car Towed by Newham council within hours, Car Towed for parking in alleged resident bay

Parked at St Lukes sq at 8.50am, there were no visible restriction signs on they bay so I assumed could park there.

When I came back at 11am, I found my car was gone. Called the police and they reported it as stolen. Then I called TRACE, this was out of curiosity and discovered that it was towed away.

So I went to the Car Pound to collect my car and get charged £265! almost half of my monthly wages. On recieving the car I notice a damage dent on the bonnet and scratch near the passenger side wheel arch. I make a huge fuss the chashier took pictures and lies about the damage and they gave me a photocopy of the form below:

I've requested Newham parking's pictures from when they issued the PCN / prior to towing, but they said it is only available after doing a paper appeal which sounds dodgy. I have tried to source pictures from the Newham council but cant find any link to do so.

Please help, how do I go about getting my money back as I have been ripped of by a money grabbing lawless council.

If there is any good news, it is that it is a total no-brainer to take them all the way to London Tribunals, as you have already paid all there is to pay and could get some, or even all of it back.

More info needed on where you parked, like a GSV link telling us where you were parked. Back of PCN useful too in case it contains fatal errors of content.

Where did you park - in recent GSV signs are there:

But the tow is, as we often see with Newham, disproportionate and this is is a level 3 priority for towing out of 4 where 1 is the most serious.

you have nothing to lose by appealing all the way to adjudication of course.

Because I have got tickets in the past for parking and I always take pictures when I park in other broroughs.I live miles away from Newham. I was also in a rush but thought that bay was not operating with its signage.

Ah I think Neil spotted what I have - the sign not facing the road. Risky to rely on this. Still, the tow is not on.

OP, you say there were no visible signs when you parked. Did you check out the sign in your photo?

Sorry, this is my mistake. There was a sign on the bay but it was not showing any information (it was the wrong way around).

You knew you were in a controlled zone and that bays in that road are permit only. You took a chance with the sign the wrong way although you knew what it says.

What you didn't reckon with was Newham's vindictive towing policy.

You can appeal on two grounds. On the PCN, that the bay sign was turned around and therefore the bay was not controlled by a sign. That the tow was disproportionate and not in the top priorities for removal (were there other permit spaces free in the street?).

Do not submit anything yet. The latest date is 27 days after recovering your car.

IMO you are bang to rights on the contravention, your only possible lifeline being their evidence.

For me, having looked at GSV there is not a chance that you did not see the traffic sign - it's a very small parking place and 1 minute's effort was all that was needed. You either didn't look or did and thought you could wing it (as you now admit) because the sign was facing other than streetwards. I think your only possible saviour might be the CEO and authority if the CEO actually took a photo of the permit sign in the next-but-one parking place or took one of your sign face on thereby giving the (false) impression that it faced the road.

So you'll need the photos and if you cannot access these online then email and say you (as person who recovered the car) need them in order see whether a contravention occurred.

This is quite concerning, because it means the CEO could have added signage of a different bay to their collection of photos and made it look as if it the sign was for the same bay that I parked in to make the PCN look legitimate (when the sign was actually inadequate).

After some more looking at other posts, it appears that the "sign is not approved within Traffic Sign Regulations and General Directions 2002". Without an approved sign, no contravention can occur. Would this be correct?

I'll email them for their pictures and post them up.

Can you believe, there is no email to contact these Newham parking on?

There is no way to contact them to request for pictures apart from writing to the appeal address
