My daughter has received a fixed penalty notice. She was parked on the road which has white lines (elongated H ). There are a few speed ramps along this road. There are no signs about parking restrictions or driveways on this road. The ticket is hand written and the police officer who placed it on the car has stuck labels on the ticket where his name and number should be. The reason for the ticket is for un-necessary obstruction. The place of the offence was in Marjoram Way in Whiteley. The officer is from Havant police station. Can anybody shed some light on this please.

So the only relevant question is did she cause an unnecessary obstruction, no lines or anything are needed for that to be an offence.
Have you got photo's of the parking or can you show us on Google streetview EXACTLY where she was parked. Any errors on an FPN (if they are errors) don't provide a defence to a criminal charge. White lines can't be enforced by council enforcement officers but the police can if they think the car is an unnecessary obstruction
The presence of any parked car is in theory an obstruction The white line, however, was painted for a purpose and, if your daughter's car prevented that purpose, the case is effectively proved She does have the option of telling the police that she's rejecting the FPN and wants the case to be heard by the magistrates In practice, the chances that she will be found Not Guilty against the opinion of a police officer are very slim and she is only making the matter much more expensive The default advice for police FPNs is to pay them |
