A Couple of months ago now, i dropped my wife at the Gym near the Cinema, using that car-park as i was going to Burger king afterwards then back home,

About an hour later i returned to pick her up from the same spot i dropped her off,


I then had a letter a couple of weeks later saying that i had parked there for an hour,

i appealed the claim saying that i had not parked there even going as far as giving time-logs of my wife texting me asking her to pick her back up,

I asked them to re-check the cameras as they would see my car exit about 2 minutes after entering in the first place,

they rejected the claim and asked for payment still,

I responded again stating that i wish to see all pictures they had taken off my car on day, under the data protection act i was well within my rights to see these,

They did not respond and it all fell silent for 2 - 3 months,

However yesterday i received another letter demanding £150 for not paying the fee originally,

Anyone have any suggestions / advice in dealing with these con-artists?

This is what's known as a double-dip error

You've acted reasonably by responding to the parking notice

Debt collectors can be safely ignored so I would do nothing until a genuine Letter Before Action arrives from Gladstones Solicitors

It will have a reference number 1*****.***
A fake Gladstones letter has the same reference as the debt collector letters

You could start to lay the paper trail by complaining to the DVLA that Minster Baywatch applied for your details without reasonable cause

Doesn't seem so no,

So its pretty much safe to ignore it unless an official letter from a Solicitors comes through?

But thanks for the advice about going to the DVLA about this, i'll nip down to the local station at some point for some advice from them in person smile.gif

They are quite litigious, so if they've breached the Code of Practice by not issuing a POPLA code then this an angle to apply pressure with.

The Minster Baywatch POPLA code starts with 411 and would normally be in Para #2 of the rejection letter

Very surprising that MB is still a member of the British Parking Association and not the IPC

In the usual run of events they have to issue this code to allow an 'independent' appeal.

But it's more interesting if they haven't issued this code.

It was an 'appeal' rejection? (Made in good time?)

If they did not supply a POPLA code in these circumstances then they appear to have breached the code of practice and would extremely unreasonable if they progressed to court as such.

Ok, bit of an update,

Their rejection letter did have a POPLA code, however was obstructed by their Logo / Watermark at the bottom of the printed letter, slight over-sight on my behalf

However, after asking them to provide all pictures of my car, they claim that there are no pictures,

So i asked for the video file for that hour - No video file apparently,

Provided text messages showing my wife asking me to pick her up - Text messages are not classed as Evidence

and their possibly best one yet - They do not have to prove my car was stationary, the charge applies for entry into the car-park, (Despite my letter is a "Parking fine")


All in all, after 4 months of fighting with them with no letter form of legal letter of anyone other than Minister Baywatch, i get the feeling they know they have no case and are just pushing their luck,



Anyone have any advice from here?

Just tell them to put up or shut up.

They have 14 days to file papers for a court claim, otherwise you will consdier the matter closed. You will note the content of other communications but will not reply.

Sounds good enough to me mate - its been sounding like they've been clutching at straws and just hoping that constant bullshit will get me to front up the cash,


Will ignore them from now on and see if i get anything in the next 14 days smile.gif

i had a letter through the post from DRP (Dept Recovery Plus Ltd)


Still safe to ignore this?

and you also found that Zenith arent a different company, in case you get letters from them in future?
You need to carefully read ALL of letters you receive - even the bits in light grey text in 6pt font at the bottom of the page biggrin.gif

I'd keep pushing, especially the POPLA angle. Check the completed cases forum as they have just won at court. (So a (robo)claim is still possible)

Are you referring to the loss by 'Mincer,' Jlc? There could be some doubt about that.
