Hi. We parked our van on residential Parking where you can park max 4 Hours if you pay. We paid by phone 1 hour + 1 hour ( 3 pounds + 3pounds). Unfortunately traffic warden gave us PCN. We have screenshot from bank where is description for who is that charge and reference number. Could someone help me write a challenge please. Photos attached. Thank you

Edit out your Vehicle reg on the PCN and photo (and edit out the PCN number on the PCN)

- also is that ALL of the front of the PCN? And we need to see the back too.


Having never paid by phone myself...I assume you get some sort of record or receipt when you do so? And / or the 2 x payments will show up on a Credit Card or Bank statement? EDIT - ignore that, you said that you have the Bank proof.


It seems your challenge would be your proof of payment screenshots - can you appeal online? If so, the Council in question may allow you to upload screenshots as supporting evidence.


As a start -


"Dear Council,


I paid for 2 x 1 hours by phone , as can be proven by the attached Bank screenshots - so this PCN should not have been issued.


Therefore it needs to be cancelled"


As long as you have proof, I don't think it needs to be any longer than that. Let's see what others come up with though.

Don't worry about editing the details on the PCN.

Lambeth uses PayByPhone - first thing to do is check the location, vehicle reg and time start/end were correct for the session you bought.

OK, you paid for 2 x 1 hour sessions, but were they over a single 2 hour period ? In other words did the second hour you paid for start at the end of the first paid hour ? If they didn't and the PCN was issued after the first hour expired but before the second hour had started you are bang-to-rights. So please explain the way you paid for parking using PbP. Did the PbP system allow you to extend a session ? If it did, I would expect the system to be programmed to only allow an extension when the first one was still valid

An interesting point is whether the systems are programmed to warn or refuse buying an invalid session. I suspect not.

He gave us the ticket during 2nd hour. He saw our van before and was ok. As you can see we loaded a van during this time, but sometimes when item is large etc it is take some time to take it out and he found this gap to give us a ticket. Reg and location number is ok.

Three points:-

(a) We have had difficulties before with a one payment session because of the max 4 hour stipulation --putting in an extra amount screws up the IT system. It recognises one payment and defaults to that being your one and only payment for the 4 hour slot.

This is exacerbated by the sign not indicating something like no return after making payment (regardless of time spent there).

(b) If the CEO gave the OP a PCN in the gap between paid for periods we need the exact time the first period ran out.

(c ) Whether there is a loading exemption needs to be considered regardless of payment.
