Hi there,

Just got this through the door. This IS my car. I'm the only person who has access to it and I was definitely ABROAD on 28th May 2018!

This aside - does anyone have any advice? I notice someone posted in 2015 about the exact same penalty on the same road. Clements Road in Redbridge, London.

Thanks so much in advance.

If this is not a cloned vehicle then, as its owner, you get the penalty under the legislation.

Others will advise you on whether TWOC is a sustainable defence.

Search for the location in this forum and you will see draft appeals which may be suitable for your case.

And still the printer is out of line so the pcn is duff.

You as the owner are liable, there is a statutory defence of the vehicle being driven without your consent, but the burden of proof falls on you. You will need to prove you were abroad and that you did not give permission for anyone to use the vehicle

What makes you so certain?

Have you seen the colour photos and the video?

For how long were you abroad?

IF the number-plate has been cloned, and you live in LB Redbridge, you should be asking LB R and perhaps TfL if there are any outstanding PCNs against your reg mark.
