Partner clamped by nighthawk., Any help would be appreciated.

Hi there, i'll jump straight in.

My partner was clamped today outside my friends flat, which is gated off. I'm not 100% sure wether it is private, so I have posted it in here for now i'll find out tomorrow morning and update the thread. My dad, my partner and me were visiting him, he is classed as mentally ill so we were just seeing how he was doing. We parked in the designated parking place outside of his house.

We come outside to find my partners car clamped, along with some disgruntled neighbours speaking to the nighthawk security clamper. It turns out the neighbours have contaced their local council who provides permits, multiple times to get their permits renewed and also be sent visitors permits but they have been told by the council that they are unable at this time to replace them and that no car shall be clamped due to this reason (one of them provided me an abbreviation of councils name but after the conversation it had slipped my mind, i'll be finding it out from her again tomorrow)

Obviously the clamper was having none of it, we needed the car to get home so I paid the charge to unclamp (£177) and I'm planning to write my appeal letter any moment.

Where do we stand on this, I'm going to contact the neighbour again tomorrow to get the information about who provides them permits. Once the council confirm that no car should of been clamped in that area, do I stand in good stead with the appeal.

Also another thing to note is the clamper said a few times; look guys we know every one here has expired permits in their window (due to the council not being able to renew them), but we dont clamp them, but I dont recognise this car, so I clamp it.

That clearly indicates that him and the company know about the permit issue, so they dont clamp any of the cars in parking area.

TL;DR - Council unable to provide new permits for residents and visitor permits. Council have apprently told nighthawk this. Car still got clamped, had to pay it and i'm lodging an appeal. If you need i'll scan receipts tomorrow too.

You MUST be persistent.

If they try to use the excuse that entering your PIN means you are not entitled to anything, you MUST call them on it. You must ask them to show to you the specific clause in their terms and conditions which verifies this. We all know there isn't one.
