I have come into possession of a NtD stuck on my car yesterday.
I intend to end up at POPLA eventually but, now that it applies to me, I need to understand in detail why we recommend appealing NtDs at day 26? I appreciate the need to avoid them contacting DVLA, but why day 26? Why not straight away? -------------------- Cabbyman 11 PPCs 0

Day 26 is close to the earliest point they can request details. So you get them involved in the process of dealing with an appeal right when they should request details.

If you appeal as the keeper then they may save themselves the cost of applying to the DVLA (£2.50) for the keeper's details but then if they don't apply to the DVLA to get the keepers details then they will not have a valid claim under POFA. So if they do not know the identity of the driver then they are snookered.
Keep up a letter ping pong, as the keeper, with the PPC until day 56 so that they cannot send a compliant NTK to you and after that you can tell them to get lost. |

Thanks for the clarification.
I'll post the NtD, suitably redacted, for your perusal later. I will also get some pics of signs. It will be interesting to see how Indigo deal with the long verbiage of the POPLA appeal that CEL, ECP and Met have all failed to contest previously. -------------------- Cabbyman 11 PPCs 0

Apparently, the driver is liable 'by remaining at this location with or without a vehicle.' This post has been edited by cabbyman: Wed, 13 Sep 2017 - 14:24 -------------------- Cabbyman 11 PPCs 0

MAY result. Not a contractual offer No contrct offered - simple pay and display. Requirement to disply is no such thing - its just a request. |

I have a diary note to appeal on day 24. I've had a look at their appeals portal and an appeal cannot be submitted without identifying the driver in mandatory fields.
As they don't appear to publish an E mail address, I will be sending it first class, PoP. Although, I'm inclined to send it twice, again by recorded delivery, as per the NtD, to see if they really sign for it! Any thoughts on that point? -------------------- Cabbyman 11 PPCs 0

You dont ID the driver. You write "I will not ID the driver" in the fields. Done.

I have just discovered that, Nosferatu. I have finally joined MSE and saw the advice in one of the threads on there.
Thanks. -------------------- Cabbyman 11 PPCs 0

In ten posts you have completed what ive done in two weeks and hours a day scanning posts making notes and trying to figure it out lol. Let us know how you get on 😂.
My only thought is they have a long time to issue the NTK, they must know the same info its a wonder they dont... |

My only thought is they have a long time to issue the NTK, they must know the same info its a wonder they dont... If you look at my profile, I'm 4500+ posts and nearly 10 years ahead of you. However, I still post the case on here because each one is different and we may find another angle to try. This is my 8th PPC engagement. Score so far? Me 7 PPC 0. Nailbiting as I await the deadline to appeal! I just hope my driver doesn't get cold feet before we've had our fun!

Is day 20 too early to appeal given that a weekend falls very close to the appeal deadline?
I'm thinking about a postal appeal rather than online because it leaves a bit more flexibility on driver's identity, which, you will appreciate, I don't wish to elaborate upon! -------------------- Cabbyman 11 PPCs 0

Do it online, if they insist on the drivers name, state "im not giving you the drivers name, you money grabbing arseholes"

Indeed, I understand the sentiment but if it went before a Judge they may not and it may cloud their Judgement.
Personally I'd just put 'appealing as keeper', it removes any negative connotations at all. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Velly intellesting!!!
I checked their website yesterday and the status 'awaiting payment.' Checking today and it doesn't allow me access to the payment portal. It was in red across the top of the page 'Please contact the debt recovery company whose details will appear on the correspondence that has been sent to you.' [Screenshot taken!] I hope that, for their sake, they have 1) included a POPLA code in the forthcoming correspondence and, 2) been to DVLA for RKs' details. I think we are going to have fun with this one peeps!!!!! -------------------- Cabbyman 11 PPCs 0
