Hi everyone, I hope you are all doing great!

I received a penalty charge for having stopped within a yellow box for less than 4 seconds as there was stationary traffic blocking my way out. Can I appeal for de minimis?

Also as soon as I realized I had no way out (I had a massive truck preceding me and couldn't see) I decelerated and I was moving through the yellow box very very slowly, but still moving, until I had to stop for a little longer than 3 seconds.

I have already appealed and received a cd, which demonstrates exactly what I said above.

What can I do now?

Thank you so much

This needs to be in the council forum. I have asked a mod to move.

Whilst stopping for between 3 to 4 seconds is usually considered de minimis, you need the video to confirm the exact stopped time. In addition, as far as TfL is concerned a nano-second stopped still justifies a PCN, so the only place this will be adjudged will be at London Tribunals with the full PCN penalty in play, (£130). So you do need to know the stopped time is very small so an adjudicator can decide in your favour.

Upoad the PCN (all sides of all pages) so we can check for errors in the small print, also upload the video to youtube or vimeo and post a link.
