As some of you already know, Matt's case is currently the subject of a Judicial Review.

With the exception of Jackie's enforcement argument, all the legal arguments are available on our member's forum.

Update 18th December 2004:

The Administrative Court has processed the application for the Judicial Review and all documents will have been served on the interested parties – District Judge Parsons and CPS Bristol – by Tuesday 21st December 2004.

This post has been locked but, when appropriate, it will be updated in order to keep you all informed of progress and many thanks to all who have contributed to the fighting fund.

Update 6th April 2005

Today, Matt received the transcript from the hearing held at the Royal Courts of Justice (RCJ) on Thursday 3rd March 2005.

Lord Justice Maurice Kay and Mr Justice Moses heard the application but the transcript does not include their judgment, which is apparently with the judges for their approval.

In summary, the application for a Judicial Review, of the decision by District Judge Parsons to refuse to state his case, was itself refused.

When Matt receives the transcript of the judgement, it is his intention to appeal to the ECHR - the RCJ, Lord Justice Kay and Mr Justice Moses have been informed of his intention.

UPDATE 4th June 2005

Both the RCJ transcript and Judgement are now available on our member’s forum and, in the opinion of one lawyer; the Judgement clarifies a point of law that had previously remained undecided.

We are in receipt of Matt’s completed ECHR submission, which will be sent to them on Monday.

When I asked Matt if he had anything that he would like to add to this post, I received the following reply:

Many thanks to Jackie for her outstanding contribution because, in my opinion, the submission makes cracking reading. icon_wink.gif

QUOTE (matt1133)
Received acknowledgement today, they received my application on the 6th of June which is good considering it was stamped by the post office in London and sent on the 7th laugh.gif

It goes on to say that the matter will be dealt with as soon as resonably practicle etc and that I may not even be required to attend icon_question.gif

The case has been assigned a reference number and the title of MIDDLETON-v-United Kingdom laugh.gif

Cheers,
matt
