  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Hello was wondering why i have been sent a NIP which is completely blank on the back as it says please complete the required sections overleaf in BLACK INK using CAPITAL LETTERS but its completely blank can anybody offer any advice please/

Sounds like a page is missing, did you just get the one sheet?

Also are you sure it's from Lancs Police? The location given is on GMP.

There are 2 church streets within half a mile of where i live but the one i use is in west lancs but its been sent from central tick office hyde but i have The NIP which is blank on the back and a sheet that says information regarding the enclosed section 172 notice but how can i fill out my details and whats the best way to go about this would you write a letter stating this and return the documents

I have no recollection of anything there was no accidents etc so what could this be for if its someone on a dash cam could you ask to see any evidence

Ok. So the request has come from GMP and you have the sheet to put your details on.

You need to respond regardless of if you agree with the allegation or not. If you don't you will commit an offence.

After Police receive your reply they will decide what they are going to do, nothing for you to do but wait and see.

Sorry, I must have misinterpreted what you put.

Nothing to stop you replying by letter however I would be mindful not to supply any more info than is required by the legislation. It may be better to call the CTO and get the missing sheet sent out.

Ok thanks but my main question is do i just return the NIP with a letter stating that where its says please fill in section A there is no section A its just blank on the back.

No, easiest to ring them, explain the problem and ask them to send you the form they would like you to fill in.

If the request is substantive then you can either ask them to provide the missing form or simply provide the required details (signed) on your own letter.

‘Ignoring’ or not providing the details will end up at court for failing to furnish. I wouldn’t bet on the missing form as a good defence.

Personally I’d call and see if they’ll divulge any details of the allegation...

You have an 'incomplete' notice that may or may not constitute a legal requirement to provide information. We cannot see your notice and cannot determine what if anything you are legally obliged to do.

I would start with pointing out that the reverse of the form was blank so you will supply the driver’s name, address, date of birth and driving licence number (assuming you know these) and offering to supply further information if they need it.
