BUS LANE PCN (WHIPPS CROSS ROAD) 1:30AM

Hi,

I received a PCN though the post last week for driving in a Bus Lane at 1:30 in the morning on Whipps Cross Road (Waltham Forest Council).
I should normally have 14 days to appeal but because the letter was dated the 7th November, and I only received the PCN last week I only have until Thursday (21st Nov)
to submit my appeal.

What frustrates me is that I was not aware that I was driving in a 24 hour Bus Lane when I came up to a junction (Greenman Roundabout).
If you have a look at the Street view links below this is where I belive I was caught but not 100% sure because the PCN does not state the precise location of where
the contravention took place.

On the night I was driving through this road the road was unlit so the risk of missing road signs were pretty high.

The streetview links I've provided below shows where I believe the contravention took place but there is no marking on the road saying 'Bus Lane'.

The Bus Lane does not look right to me, what do you think?

P.S The quality of CCTV footage was poor, you can only see the outline of my car with the word 'Bus Stop' in the road as I drove through this supposed Bus Lane.

There's a sign back up at the start of the bus lane, at least when the Google streetcar passed through. Was it there at the time of the alleged incident?

I've had a lot of dealings with this bus lane in the past, getting loads of PCNs cancelled for family and friends because the bus lane was non-compliant (signs and road markings) when they first put a camera there.

Whipps Cross Road Bus Lane

LBWF took the camera down and made the necessary changes to make the bus lane compliant after I had email exchanges with Clyde Loakes and their (useless) highways team.

The camera has been recently reinstated. The only changes to signs and road markings is the removal of the End of Bus Lane sign.

My wife got snagged again huh.gif She should have known better. I couldn't see anything to appeal on. Initially I thought no end of bus lane sign would be a perfect get out but I've surprisingly found this not to be a mandatory requirement. We paid up.

I've got recent photos if that helps, plus it's only a few mins away so can assist with collecting more data if needed. Also got a copy of the traffic order which is tricky to get the exact start and end of the lane.

It's a 24 hour bus lane - quite a short one and few buses use that road.

Someone needs to check the video and PCN for any angles.

The only other thing I considered was the short distance from end of bus lane to the traffic lights. I never timed the lights properly but there are recommended distance and timings with a bus lane so close to the lights.
