VCS at JLA and RK driving assumption

Thinking sideways on this

My wife has no licence. could she be the RK although i own the car, and would this affect insurance?

So should i ever go to JLAand they assume the RK is the driver, their supposition would fall apart?

I’m not seeing how a representation to the DVLA that Mrs is to be registered as the RK (made by Mrs not Mr, by the way) is false in any way - it has to be untrue or misleading. What is untrue or misleading about Mrs asking to be noted as the RK? The purpose, taken at it’s highest, is to avoid Mr being held liable using POFA for private tickets. There’s no risk of loss to the PPC, as they still have an RK to claim against. The only question is a risk of loss to the Mrs or a gain to the Mr and, absent fraud on the Mrs, one presumes that was consented to.

I don’t see this as being very, if at all, different from various perfectly legal arrangements to protect assets or minimise liabilities, such as using companies or trusts.
