FightBack Forums _ Speeding and other Criminal Offences _ NIP - Mobile Speed Camera Parked on Central Reservation

Hi there,

My wife received a NIP for her car, which I was driving on the 17th Aug (she's not filled it in or returned it yet). Car is in her name, and she's the regular driver - however on this occasion I was driving.

It was my first time driving in Crawley, and was 17:02 - so rush hour. I missed a slip road while exiting a roundabout (Hazelwick), resulting in my entering what looked like a 40 mph zone (photos attached). Google maps shows the 30 mph signs are there, however in my fluster of missing the exit, I missed them.

I saw the mobile speed camera unit/van, however assumed wrongly I was going under the speed limit.

I remember at the time thinking it was a bit sneaky how it was parked. It was fully up on the central reservation very close to the roundabout (Manor Royal / Gatwick Road roundabout), pointing southbound. If any member of the public had parked there, I think the police would have found issue with it.

In my 20 years' of driving, I've never received a speeding ticket, been pulled, or had an accident. I've managed to gain 20 years NCB for insurance too.

I'm also a member of our village community speed watch (backed by Sussex Police and involves a 30 minute online exam and training), where we have a 60 mph >> 40 mph >> 30 mph in a close area, with a school, shop and zebra crossing, with many going through the village at 50+ with some very dangerous driving and near-misses.

I love driving, love cars and hate speeding in inappropriate areas. It's these sneaky tactics in areas and at times where it's purely a money making exercise which annoys me.

I've highlighted in red where the mobile speed camera van was parked. Do I have any grounds for appeal based on the info above?

Thanks....

Regardless of where they were parked, it does not affect any evidence they gather.

From memory - I think most sites maxed out at 15+, but in my mind it's 20 biggrin.gif

Thanks - I've read some of the other threads, and looks like I'll just have to take this one on the chin.

I am afraid that the police can be as sneaky as they like in locating cameras, up to and including using a parked horse-box http://www.dailymail.co.uk/news/article-551108/The-shocking-picture-shows-police-ANYTHING-hide-speed-cameras-unsuspecting-motorists.html Any evidence they gather will still be admissible, even if they were parked illegally (and often there is some exemption for police activity anyway)
