Hi, I am absolutely fuming! I have just been caught speeding doing 70mph in a 50 zone, I have already got 6 points from a previous ban over 3 years ago. I really don't want to get banned again I'm nearly in tears because I know it's my own fault.
What's the best and worst case scenario? Thanks |

If it is over 3 years the points you had won't count for trotting up.
You will be unlucky to get more than 3 points at that speed - a ban is very unlikely unless there is more to it. This post has been edited by uk_mike: Mon, 20 Aug 2012 - 19:48 |

No theres nothing more to it, it was a parked up police car with a laser gun that got me so he followed me and pulled me over, dont know if that makes any difference. I've had the 6 points on my license for over 3 years but I was told you cant get them taken off until after 4 years? is that right?
Thanks |

Correct, but they become inactive after 3 years. So you are on 0 points right now.

That makes me feel much better. It is a bit silly that you can't have them taken off for another year after they have become inactive....

That's right.
I'm surprised they did not issue an FPN at that speed. If they have asked you to produce your licence they may still issue with one. If not the guideline is 4-6 points, and some grovelling to the magistrate should get you down to 4 even 3 if he is having a good day and you give a decent mitigation. In that case a early guilty plea when the summons comes in, and a suitably contrite mitigation statement, should limit the damage somewhat.
Folks here can advise on mitigation when you have the summons. |

sorry for being dumb, but what do you mean by a 'suitably contrite mitigation statement'?

sorry for being dumb, but what do you mean by a 'suitably contrite mitigation statement'? Say how mortified and sorry you are by why you did, and highlight any factors that may make less serious, eg dry, little traffic etc. The aim is to convince the magistrate that what you did was really very minor and that you will not be doing it again. |

That makes me feel much better. It is a bit silly that you can't have them taken off for another year after they have become inactive.... ...and some insurers want to know about them for 5 years. If it is over 3 years the points you had won't count for trotting up. Is that only when on a horse? Hi, I am absolutely fuming! I have just been caught speeding doing 70mph in a 50 zone It might be worth checking with the local council that the Traffic Regulation Order (TRO) is all in order - this can legally define the speed limit (any may have a mistake). -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |
